REMUNERATION TRIBUNAL
Explanatory Statement: Determination 2007/03
Remuneration and Allowances for Holders of Public Office and Members of Parliament
1. The Remuneration Tribunal has inquired into and determined the remuneration and significantly related matters for office holders, as it is empowered to do by the Remuneration Tribunal Act 1973.
2. In making this determination the Tribunal has informed itself through consultation in accordance with established practice.
3. Any retrospective application of this determination is in accordance with subsection 12(2) of the Legislative Instruments Act 2003 as it does not affect the rights of a person (other than the Commonwealth or an authority of the Commonwealth) to that person’s disadvantage, nor does it impose any liability on such a person.
PART 1 – PART-TIME OFFICES
4. Clause 1.2 deletes all references to offices associated with six obsolete bodies or authorities.
5. Clauses 1.3 to 1.7 reflect name changes for various offices. The associated fees and entitlements are not new or changed.
6. Clauses 1.8 and 1.9 set remuneration for a new office, Chairs of the Research Quality Framework Assessment Panels, with effect on and from 17 April 2007.
7. Clauses 1.10 to 1.12 provide for an increase in remuneration for the Chairmen and Members of Tax Agents’ Boards, with effect on and from 15 May 2007. They also allow these office holders to record individual periods of business of a minimum of six minutes for the purpose of the payment of a daily fee for non-meeting days.
8. Clause 1.13 provides for Members of Tourism Australia’s Audit Committee to receive additional audit committee fees.
9. Clauses 1.14 to 1.15 provide for an increase in remuneration for the Members of the National Water Commission, with effect from 1 July 2006.
10. Clauses 1.16 to 1.17 provide for a decrease in remuneration for the Chairman and Members of the Australian Industry Development Commission, with effect from 7 May 2007.
PART 2 – FULL-TIME OFFICES
11. Clause 2.1 specifies the Principal Determination (Number 13 of 2006 as amended) for the purposes of Part 2 of the Determination.
12. Clause 2.2 deletes reference to the Accommodation Allowance provided to the former Sex Discrimination Commissioner, Ms P Goward.
13. Clauses 2.3 to 2.5 delete all references to the Accommodation Allowance and Reunion Travel provided to the former Chairman of the Australian Securities and Investment Commission, Mr Jeffrey Lucy, with effect from 13 May 2007.
PART 3 – MEMBERS OF PARLIAMENT
14. Clause 3.1 specifies the Principal Determination (Number 18 of 2006 as amended) for the purposes of Part 3 of the Determination.
15. Clause 3.2 amends the provisions in clauses 8.7 and 8.8 of the Principal Determination to clarify the conditions under which the Resettlement Allowance becomes operational and payable.
