REMUNERATION TRIBUNAL

Explanatory Statement:  Determination 2006/07

Remuneration and Allowances for Holders of Part-time Public Office

1.

The Remuneration Tribunal has inquired into and determined the remuneration and significantly related matters for public office holders, as it is empowered to do by the Remuneration Tribunal Act 1973.

In making this determination the Tribunal has informed itself through consultation in accordance with established practice.

PART 1 – GENERAL

2.

Part 1 of the Determination specifies the authority for and the date of effect of the Determination.  It supersedes and revokes the previous principal Determination (2005/05).  The clause in Part 1 of the superseded Determination relating to the legal status of footnotes has been removed, as explained in Clause 4 below.

PART 2 – FEES

3.

Part 2 sets out fees for public offices not specified in the Determination, and the related Schedules set out the fees payable to specified office holders, expressed either as an annual and per diem rate. The fees incorporate a 4.0 per cent per annum increase (rounded) effective on and from 1 July 2006 for the Part-time Office Holders covered by the Determination, following the annual review of remuneration.

4.

The formatting of Tables A1A and C1A in Part 2 has been substantially amended.  Those Tables in the superseded Determination had numerous footnotes attached to various entries in the Tables, often containing substantive information about remuneration for office holders.  These footnotes have been omitted, as well as the Clause in Part 1 clarifying their legal status; and the information formerly in those footnotes has now been placed in Clauses A1 to A37 and C1 to C8 following the respective tables.  This has not resulted in any substantive change to any office holder, other than the 4.0 per cent increase.

5.

The method of identifying the frequency of payments in Tables A1A and C1A has also changed.  The columns containing ‘p/a’ and ‘p/d’ have been deleted; instead the fees are annual fees except where printed in italics, when they are daily fees.

5.

Part 2 also sets out the payment conditions for both specified and unspecified offices.

PART 3 – TRAVEL ALLOWANCE

6.

Part 3 sets out the entitlements for official travel.  This Part is unchanged from Determination 2005/05.

Authority: Sub-sections 7(3) and 7(4) of the Remuneration Tribunal Act 1973

Overview

The Remuneration Tribunal Act 1973 was enacted to establish the Remuneration Tribunal, which is responsible for determining the remuneration and allowances for holders of part-time public office. This Act empowers the Tribunal to review and adjust the remuneration and related matters for public office holders, ensuring that these adjustments are consistent with the established practices and requirements of public service roles. The explanatory statement accompanying the Determination 2006/07 indicates that the Tribunal has considered public consultation as part of its process in setting the remuneration for part-time office holders. This determination incorporates a 4.0 per cent increase in fees, effective from 1 July 2006, and updates the presentation of fee information by removing footnotes and clarifying the payment conditions. The Act aims to maintain transparency and fairness in the remuneration of part-time public office holders, ensuring their compensation aligns with the duties and responsibilities of their roles.

Scope and Application

The Remuneration Tribunal Determination 2006/07, made under the Remuneration Tribunal Act 1973, applies to the remuneration and allowances for holders of part-time public offices within Australia. This Determination supersedes and revokes the previous principal Determination (2005/05) and sets forth the fees for public offices, both specified and unspecified, as well as conditions for travel allowances. It applies to public office holders across various jurisdictions within Australia, providing them with updated rates following an annual review. The Determination also incorporates a 4.0 per cent per annum increase effective from 1 July 2006. Notably, the Determination clarifies the method of identifying fees, distinguishing between annual and daily fees, and relocates substantive information previously contained in footnotes to specific clauses. The scope of the Determination is limited to remuneration and allowances, and does not extend to other areas such as employment conditions or benefits outside of these specified payments.

Key Provisions

The Remuneration Tribunal has determined the remuneration and allowances for holders of part-time public office under the Remuneration Tribunal Act 1973, as detailed in the 2006/07 Determination (sections 2-5). This Determination supersedes and revokes the previous principal Determination (2005/05) and incorporates a 4.0 per cent increase in fees effective from 1 July 2006 (section 3). The fees for unspecified offices are outlined in Part 2, with specific fees for designated offices listed in the accompanying schedules, expressed as either an annual or per diem rate (section 3). The format of Tables A1A and C1A in Part 2 has been revised, with substantive information formerly contained in footnotes now integrated into Clauses A1 to A37 and C1 to C8 following the respective tables (section 4). Payments are now identified as annual fees unless specified in italics as daily fees (section 5). The obligations and requirements imposed by this Determination include adherence to the specified fees for part-time public office holders, with a 4.0 per cent increase effective from 1 July 2006 (section 3). The Tribunal has also updated the format of the fees tables, with substantive information previously in footnotes now integrated into specific clauses (section 4). Furthermore, the payment conditions for both specified and unspecified offices are set out in Part 2 of the Determination (section 5). Public office holders must comply with these remuneration and allowance provisions as stipulated in the Determination. The Determination does not explicitly outline specific offences, penalties, or civil/criminal consequences for breaches. However, non-compliance with the remuneration and allowance provisions could potentially lead to disputes or legal actions under the Remuneration Tribunal Act 1973, which may result in various legal consequences depending on the nature and severity of the breach. The maximum penalties for breaches of the Act are not specified in the Determination but would be determined by the relevant courts or tribunals in accordance with the Act. In summary, the Remuneration Tribunal's 2006/07 Determination outlines the remuneration and allowances for part-time public office holders, incorporating a 4.0 per cent increase effective from 1 July 2006. The Determination also revises the format of fees tables and payment conditions. Public office holders are required to adhere to these provisions, and while specific penalties for breaches are not detailed in the Determination, non-compliance could result in legal consequences under the Remuneration Tribunal Act 1973.
