Overview

The Remuneration Tribunal Determination 2006/04, enacted under the authority of the Remuneration Tribunal Act 1973, serves to address the remuneration and allowances for holders of public office in Australia. This legislation was introduced to ensure that office holders receive appropriate compensation and allowances that are reflective of their responsibilities and the demands of their roles. The Tribunal, as an independent body, has the mandate to inquire into and determine these matters through consultation, adhering to established practices. The Explanatory Statement clarifies that any retrospective application of this determination does not adversely affect the rights of individuals, nor does it impose any liability, as it complies with the provisions of the Legislative Instruments Act 2003. This determination specifically outlines allowances for both full-time and part-time office holders, including details such as accommodation allowances and travel entitlements for the Chairman of the Australian Securities and Investments Commission. The Remuneration Tribunal, operating under the legislative framework provided by the Remuneration Tribunal Act 1973, aims to maintain transparency and fairness in the remuneration of public office holders. The 2006 determination addresses specific cases, such as setting allowances for the Chairman of the Australian Securities and Investments Commission and adjusting the name of a part-time office group to reflect current nomenclature. This legislative measure ensures that public officials are compensated appropriately, thereby upholding the integrity and efficiency of public service roles. The Tribunal's determination is grounded in consultation and adherence to legal mandates, ensuring that the remuneration aligns with the responsibilities and contributions of the office holders.

Scope and Application

The Remuneration Tribunal, pursuant to the Remuneration Tribunal Act 1973, has determined remuneration and allowances for holders of public office, detailing specific allowances for full-time and part-time office holders. This determination applies to office holders, including the Chairman of the Australian Securities and Investments Commission, Mr Jeffrey Lucy, and others specified in the Principal Determinations. The allowances cover accommodation, travel entitlements, and other related matters. The determination sets out particular allowances for Mr Lucy, such as an accommodation allowance and travel entitlements, with specific effective dates. It also updates the name of a part-time office group to reflect its current designation. This legislation is applicable within the Commonwealth jurisdiction and includes provisions for retrospective application that do not adversely affect the rights of individuals or impose liabilities, as per subsection 12(2) of the Legislative Instruments Act 2003. The scope of this determination is defined by subordinate instruments under the Remuneration Tribunal Act 1973, which provides the Tribunal with the authority to make such determinations.
