Overview

The Remuneration Tribunal Determination 2005/13, known as the Official Travel by Office Holders and Members of Parliament, was enacted to address the need for updated travel allowances for office holders and members of parliament. This determination was issued under the authority of the Remuneration Tribunal Act 1973, with the primary objective of ensuring that the remuneration and related matters for these individuals are reviewed and adjusted in accordance with established practices. The determination was made by the Remuneration Tribunal, which consulted extensively before making these updates effective from 28 August 2005. The changes primarily involve the revision of travel and motor vehicle allowance rates to reflect current conditions and needs, as outlined in the Principal Determinations referenced within the determination.

Scope and Application

The Determination 2005/13 issued by the Remuneration Tribunal under the Remuneration Tribunal Act 1973 pertains to the remuneration and related travel allowances for office holders and Members of Parliament in Australia. This determination applies to all office holders as defined by the Remuneration Tribunal Act 1973 and to Members of Parliament, which includes individuals serving in the Federal Parliament. It sets out updated travel and motor vehicle allowance rates, effective from 28 August 2005, which are intended to reflect changes in the costs associated with travel and transport. The determination encompasses both Commonwealth and state levels, ensuring a uniform approach to the allowances across the country. Notably, this legislation does not specify any exclusions or exemptions; however, the applicability of these allowances may be further refined or expanded through subordinate instruments issued under the authority of the Act.

Key Provisions

The legislation F2005L02224, titled "Official Travel by Office Holders and Members of Parliament," is a determination made by the Remuneration Tribunal under the authority of the Remuneration Tribunal Act 1973. This determination, specifically numbered 2005/13, updates and specifies the travel allowances for both office holders and members of parliament. Clause 1.1 (3) refers to the Principal Determination (Number 3 of 2004) for office holders, while Clause 2.1 (8) refers to the Principal Determination (Number 8 of 2005) for members of parliament. Both clauses provide the foundational documents for the respective updates in travel and motor vehicle allowances. Under this determination, Clause 1.2 updates the travelling allowance rates listed in Schedule A of the Principal Determination for office holders, and Clause 1.3 updates the motor vehicle allowance rates listed in Table 4A, both effective from 28 August 2005. Similarly, Clause 2.2 updates the travelling allowance rates for members of parliament, as specified in Table 1A of the Principal Determination, and Clause 2.3 updates the specific allowance rate for the Prime Minister, all also effective from the same date. These clauses ensure that the allowances are current and reflective of any changes in travel costs or other relevant factors. The obligations imposed by this legislation on office holders and members of parliament primarily revolve around the accurate reporting and claiming of travel expenses within the updated allowance rates. Office holders and members of parliament must ensure that any travel expenses claimed are within the specified limits and are justified as necessary for the performance of their duties. Additionally, they are required to provide any necessary documentation to support their claims in line with the updated allowance rates. Failure to comply with these requirements may result in the disallowance of the claimed expenses or further investigation into the claimed amounts. There are no specific offences, penalties, or civil/criminal consequences outlined within the determination itself. However, any breaches of the obligations and requirements, such as misreporting or fraudulent claims, may be subject to the broader legal frameworks that govern public office and parliamentary conduct. This could potentially include investigations by relevant authorities, disciplinary actions by the respective parliamentary bodies, or other legal consequences depending on the severity and nature of the breach. It is important for office holders and members of parliament to adhere strictly to the updated allowances and reporting requirements to avoid any potential repercussions.
