1  Section 7 (definition of official travel determination)

Omit “Determination 2017/15: Official Travel by Office Holders”, substitute “the Remuneration Tribunal (Official Travel) Determination 2018”.

Overview

The Remuneration Tribunal (Departmental Secretaries—Classification Structure and Terms and Conditions) Amendment (Official Travel) Determination 2018 was enacted to amend the existing remuneration structure for departmental secretaries, specifically in relation to official travel arrangements. This determination was introduced to address the need for updated travel-related provisions within the remuneration framework, ensuring that the conditions for departmental secretaries' travel are consistent with the latest determinations regarding official travel. The determination was made by the members of the Remuneration Tribunal, as authorised under Division 4 of Part II of the Remuneration Tribunal Act 1973. The policy objective behind this amendment was to ensure that the remuneration structure accurately reflects the updated official travel arrangements as stipulated in the Remuneration Tribunal (Official Travel) Determination 2018.

Scope and Application

The Remuneration Tribunal (Departmental Secretaries—Classification Structure and Terms and Conditions) Amendment (Official Travel) Determination 2018 applies to the Departmental Secretaries’ Classification Structure and Terms and Conditions as set forth in the Remuneration Tribunal (Departmental Secretaries—Classification Structure and Terms and Conditions) Determination 2018. This amendment, which took effect on 26 August 2018, is made under Division 4 of Part II of the Remuneration Tribunal Act 1973. It amends the definition of "official travel determination" to replace the reference to the Determination 2017/15: Official Travel by Office Holders with the Remuneration Tribunal (Official Travel) Determination 2018. This change ensures the application of the most recent travel regulations to the classification structure and terms and conditions of departmental secretaries. The amendment does not specify any exclusions or thresholds, nor does it extend or restrict the application beyond the terms provided in the Schedule. The geographic and jurisdictional reach of this amendment is limited to the Commonwealth, applying specifically to departmental secretaries within the federal government.

Key Provisions

The main operative sections of the Remuneration Tribunal (Departmental Secretaries—Classification Structure and Terms and Conditions) Amendment (Official Travel) Determination 2018 (the 'Determination') provide for amendments to the Remuneration Tribunal (Departmental Secretaries—Classification Structure and Terms and Conditions) Determination 2018, which itself deals with the classification structure and terms and conditions of departmental secretaries. Specifically, Section 1 of the Determination names the instrument and Section 2 sets out the commencement date, which is 26 August 2018, the same date as the Remuneration Tribunal (Official Travel) Determination 2018. Section 3 specifies the authority under which the Determination is made, being Division 4 of Part II of the Remuneration Tribunal Act 1973, and Section 4 details the amendments made through Schedule 1. The Determination imposes certain obligations and requirements on the parties it governs. It amends the definition of "official travel determination" in Section 7 of the 2018 Determination by replacing the reference to "Determination 2017/15: Official Travel by Office Holders" with "the Remuneration Tribunal (Official Travel) Determination 2018". This amendment ensures that the definition aligns with the updated travel determination for the relevant period. The obligations and requirements flowing from this amendment are primarily administrative, ensuring that the definitions used in the 2018 Determination are consistent with the most current travel determinations. There are no specific offences, penalties, or civil/criminal consequences outlined within the Determination itself. The Determination focuses on amending definitions and aligning the 2018 Determination with the 2018 Official Travel Determination. However, it is important to note that breaches of the terms and conditions or failure to comply with the Remuneration Tribunal Act 1973 or related instruments could lead to separate legal consequences. The Determination does not stipulate any penalties but directs that compliance with the updated definitions is mandatory for the relevant period.
