Overview
The Remuneration and Allowances Regulations 1974 were enacted to provide specific remuneration and allowances for officers appointed to the Grants Commission, ensuring alignment with their previous roles within the Public Service. This legislative instrument was made under the Remuneration and Allowances Acts 1973 by the Governor-General, acting on advice from the Executive Council, and was intended to address the need for a consistent and equitable approach to the remuneration of public officers transitioning to roles within the Grants Commission. The policy objective behind these regulations is to maintain continuity and fairness in the compensation of officers who are redeployed from other significant positions within the Public Service, ensuring that their new roles are appropriately valued and incentivized.
Scope and Application
The Remuneration and Allowances Regulations, issued under the Remuneration and Allowances Acts 1973, provide specific provisions for the remuneration and annual allowance of an individual appointed as a full-time member of the Grants Commission. The regulations apply to a person who, prior to their appointment, was an officer of the Public Service and was the holder of the office of Secretary to the Department of Housing as of 29 November 1973. This individual is entitled to receive remuneration and an annual allowance at the rates applicable to the office of Permanent Head of a Department of the Public Service, other than a Department of the Parliament, for the duration of their appointment to the Grants Commission, including any period of re-appointment. The scope of these regulations is geographically and jurisdictionally limited to the Commonwealth of Australia and applies specifically to the circumstances outlined in the regulations, without extending to other individuals or offices. The regulations do not provide for any exclusions, exemptions, or thresholds beyond those explicitly stated. The application of these regulations may be further extended or specified through subordinate instruments, as deemed necessary by the Governor-General acting on the advice of the Executive Council.
Key Provisions
The Remuneration and Allowances Regulations 1974 (section 1) establish the framework under which specific remuneration and allowances are set for public service officers, particularly those appointed to the Grants Commission. Under section 2, a person appointed as a full-time member of the Grants Commission, who was previously an officer of the Public Service and specifically the Secretary to the Department of Housing as of 29 November 1973, is entitled to receive remuneration and an annual allowance at rates applicable to the office of Permanent Head of a Department of the Public Service, excluding those of the Parliament, for the duration of their appointment, including any reappointment.
These regulations impose specific obligations on the designated officers. The primary obligation, as per section 2, is to ensure that the appointed full-time member of the Grants Commission receives remuneration and annual allowance rates that are consistent with those of a Permanent Head of a Department of the Public Service, excluding Parliamentary departments. This provision aims to maintain consistency and fairness in the remuneration framework across public service roles.
In terms of compliance, breaches of these regulations could lead to serious consequences. Although specific offences and penalties are not detailed within the provided text, under the general legislative framework, breaches of such regulations could result in civil or administrative penalties. These might include fines or other sanctions imposed by relevant authorities. The severity of these penalties could depend on the nature and extent of the breach, and could be determined by relevant legislative provisions or administrative guidelines. It is important for parties involved to adhere strictly to these regulations to avoid potential legal repercussions.
