Overview

Statutory Rules 1975 No. 31, made under the Remuneration and Allowances Acts 1973, sets out regulations concerning the remuneration of officers appointed to various high-ranking positions across different commissions and corporations. This regulation was enacted to ensure that the remuneration of these officials is appropriately aligned with their roles and responsibilities, particularly when they transition from other public service positions. The regulations aim to maintain consistency and fairness in the remuneration structure for key officials within government-affiliated entities. This legislative instrument was issued by the Administrator of the Government of Australia, acting on the advice of the Executive Council, and was notified in the Australian Government Gazette on 18 March 1975.

Scope and Application

The Remuneration and Allowances Regulations 1975 under the Remuneration and Allowances Acts 1973 pertains to the payment of remuneration to specific officers appointed to various high-level positions within certain Australian government commissions and corporations. This legislation applies to individuals who have been appointed to positions such as Associate Commissioner of the Industries Assistance Commission, Commissioner of the Hospitals and Health Services Commission, General Manager of the Health Insurance Commission, and others, provided they were previously serving in specified roles within the Australian Public Service or other designated offices. The regulation stipulates the remuneration rates applicable to these officers during their appointment period, ensuring that they receive appropriate compensation reflective of their new roles. The regulation has a national reach, as it is a Commonwealth regulation, and it does not explicitly exclude any categories of persons or entities, although the applicability is inherently limited to those appointed to the specified positions. There are no stated exemptions or thresholds within the text, and the regulation extends its application by detailing specific remuneration rates for each position mentioned.

Key Provisions

The Statutory Rules 1975 No. 31 Regulation under the Remuneration and Allowances Acts 1973 introduces specific provisions for the remuneration of various officers in certain public service roles. Regulation 3 specifies that an Associate Commissioner of the Industries Assistance Commission, previously a First Assistant Commissioner in the Trade Practices office, will receive remuneration applicable to a Level 3 Second Division officer in the Australian Public Service. Regulation 4 details that an Associate Commissioner of the National Capital Development Commission, previously the Secretary and Manager of that commission, will receive remuneration at specified rates depending on the date of appointment. Regulation 5 states that a full-time Commissioner of the Hospitals and Health Services Commission, previously a First Assistant Director-General in the Department of Health, will receive remuneration applicable to a Level 3 Second Division officer in the Australian Public Service. Regulation 6 provides that the General Manager of the Health Insurance Commission, previously a First Assistant Director-General in the Department of Social Security, will receive remuneration applicable to a Level 3 Second Division officer in the Australian Public Service. Regulation 7 details that a Commissioner of the Repatriation Commission, previously a First Assistant Commissioner in the Department of Repatriation and Compensation, will receive remuneration applicable to a Level 3 Second Division officer in the Australian Public Service. Regulation 8 specifies that a Deputy Chairman of the Social Welfare Commission, previously a First Assistant Director-General in the Department of Social Security, will receive remuneration applicable to a Level 3 Second Division officer in the Australian Public Service. Lastly, Regulation 9 states that a Deputy Managing Director of the Export Finance and Insurance Corporation, previously the General Manager of the Export Payments Insurance Corporation, will receive remuneration at the rate of $21,417 per annum. The Regulation imposes specific obligations on the entities involved to ensure that the remuneration of these officers is adjusted in accordance with the outlined rates. These obligations include ensuring that the correct remuneration is paid to the officers appointed to these positions, as specified in the regulations, and maintaining records to demonstrate compliance with these provisions. It is essential that the entities verify the previous positions of the officers before making any payments and that they adhere to the specified remuneration rates. The Statutory Rules 1975 No. 31 Regulation does not explicitly outline specific offences, penalties, or consequences for non-compliance. However, non-compliance with the remuneration provisions could potentially lead to legal disputes regarding the appropriate remuneration for these positions. The consequences of such disputes could include financial liabilities for the entities involved and the need to rectify any underpayment or overpayment of remuneration to the affected officers. While the Regulation itself does not detail specific penalties, any resultant legal actions or disputes could lead to financial repercussions and the requirement to rectify any discrepancies in remuneration.
