Overview

Statutory Rules 1975 No. 137, made under the Remuneration and Allowances Act 1973-1975, was enacted to ensure consistent and fair remuneration practices for various statutory officeholders across different boards and authorities. This legislative instrument addresses the need to align the remuneration of certain officeholders with their previous positions within the Australian Public Service or other designated roles. It was introduced by the Governor-General of Australia, acting on the advice of the Executive Council, and aims to provide clear guidelines on remuneration and allowances for specified positions. The policy objective is to maintain equitable compensation structures that reflect the responsibilities and qualifications of the officeholders.

Scope and Application

The Remuneration and Allowances Regulations 1975, made under the Remuneration and Allowances Act 1973-1975, govern the remuneration and allowances for specific officers appointed to certain statutory offices within the Australian Public Service. These regulations apply to individuals who are appointed to offices such as the Chairman of the Industrial Research and Development Grants Board, full-time members of the Schools Commission, and various Chairman roles within Repatriation Boards and the Australian Capital Territory Electricity Authority. The regulations are specific to individuals who were previously officers of the Australian Public Service, occupying certain classifications within the Third Division or equivalent positions. The scope of these regulations extends to the Commonwealth level, impacting federal public service officers across Australia. Notably, the regulations exclude any provisions that were applicable to remuneration and allowances before 1 March 1975, emphasising their focus on remuneration from that date onwards. These regulations are enforced through subordinate instruments, which detail the specific remuneration rates applicable to each office, ensuring clarity and consistency in the application of the Act.

Key Provisions

The Remuneration and Allowances Regulations, as amended by Statutory Rules 1975 No. 137, introduce specific provisions for the remuneration of individuals holding particular statutory offices. Regulation 1a clarifies that any remuneration or annual allowance provisions set out in the regulations for periods before 1 March 1975 do not apply to holders of those offices from 1 March 1975 onwards. Subsequent regulations (10 to 18) detail the specific remuneration rates for individuals appointed to various offices, including the Chairman of the Industrial Research and Development Grants Board, full-time members of the Schools Commission, Directors of the Legislative Drafting Institute, and Chairmen of Repatriation Boards for different states and territories, as well as the Chairman of the Australian Capital Territory Electricity Authority. These regulations impose clear obligations on the relevant authorities to ensure that the specified remuneration rates are adhered to for the individuals in the designated positions. For instance, Regulation 10 mandates that a person appointed as Chairman of the Industrial Research and Development Grants Board, who was previously an officer in Class 11 of the Third Division of the Australian Public Service, should receive remuneration at the maximum rate applicable to that classification. Similar obligations are set out in Regulations 11 to 18 for other specified offices. There are no explicit offences, penalties, or civil/criminal consequences mentioned in the regulations for breaches of these remuneration provisions. However, it can be inferred that non-compliance with these regulations could lead to legal challenges or administrative consequences, as the regulations are made under the authority of the Remuneration and Allowances Act 1973-1975, which would typically include mechanisms for enforcement and redress.
