THE WATER EFFICIENCY LABELLING AND STANDARDS REGULATOR

NOTICE UNDER SUBSECTION 28(1) OF THE

WATER EFFICIENCY LABELLING AND STANDARDS ACT 2005

I, Jo Townsend, Assistant Director, Water Efficiency Labelling and Standards (WELS), authorised delegate of the Regulator, pursuant to section 25 of the Water Efficiency Labelling and Standards Act 2005 (the WELS Act), register the following WELS product(s) under subsection 28(1) of the WELS Act. WELS registrations are subject to the conditions set out in subsections 4.5, 4.6 and 4.7 of AS/ANZ 6400:2005 Water efficient products–Rating and labelling.

Overview

The Water Efficiency Labelling and Standards Act 2005 was enacted to address the problem of water wastage in Australia by promoting the use of water-efficient products in households and businesses. This Act established the Water Efficiency Labelling and Standards (WELS) scheme, which aims to provide consumers with clear and accurate information about the water efficiency of products. The Act was passed by the Australian Parliament with the policy objective of reducing water consumption and conserving this precious resource through the implementation of a nationally consistent water efficiency labelling and standards system. The WELS scheme operates under the authority of the Water Efficiency Labelling and Standards Regulator, who is responsible for administering the Act and ensuring compliance by product manufacturers and importers. This includes the registration of water-efficient products that meet the WELS standards and the enforcement of compliance with the requirements of the Act.

Scope and Application

The Water Efficiency Labelling and Standards Act 2005 (the WELS Act) applies to products that are subject to water efficiency labelling and standards. The Act regulates the rating and labelling of water-efficient products, and the registration of these products must comply with the standards set out in the Act. The Act applies to various types of water-using products, including showerheads, tap and tap outlet sets, toilets, and clothes washing machines. The Act applies to these products regardless of whether they are manufactured, supplied, or installed within Australia. The Act extends to products manufactured, supplied, or installed in the Commonwealth, states, and territories of Australia. The Act includes provisions for exemptions and exclusions, as well as thresholds for product registration. Subordinate instruments may further extend or restrict the application of the Act. The registered WELS products are subject to the conditions set out in the relevant Australian/New Zealand Standard.

Key Provisions

The Notice issued under subsection 28(1) of the Water Efficiency Labelling and Standards Act 2005 (the WELS Act) pertains to the registration of various water-efficient products by the Water Efficiency Labelling and Standards (WELS) Regulator. These products, which include shower heads, taps, toilet suites, and clothes washing machines, have been registered following the assessment and certification process as outlined in the relevant standards (subsections 4.5, 4.6, and 4.7 of AS/ANZ 6400:2005). Each product type and model is identified by its brand name, family name, and model reference, accompanied by a unique registration number. For instance, Aquatica's range of 3-star and 4-star rated shower heads and tapware, Caromat's 4-star toilet suites, and various washing machine models from brands such as BLG, ALG, and SMEG, among others, have been registered. The obligations imposed by the WELS Act on entities such as manufacturers, importers, and suppliers involve ensuring that the products they market meet the water efficiency standards set by the Act. These entities must comply with the labelling requirements, ensuring that products bear the WELS label and provide consumers with information on the water efficiency of the product. Additionally, they must ensure that the products are tested and certified by an accredited WELS assessor before being marketed in Australia. Failure to comply with the requirements of the WELS Act can lead to civil and criminal penalties. Under the Act, non-compliance with the labelling requirements, or the supply of products that do not meet the water efficiency standards, can result in infringement notices being issued. The maximum penalty for an individual is $22,222, while for a body corporate, the penalty can be significantly higher, reaching up to $1,111,110. In more severe cases, criminal proceedings can be initiated, leading to heavier penalties. The Act provides the courts with the discretion to impose fines and even imprisonment for serious or repeated breaches, reflecting the importance of water conservation and efficiency in Australia.
