NOTICE UNDER SUBSECTION 28(1) OF THE

WATER EFFICIENCY LABELLING AND STANDARDS ACT 2005

I, Josephine Townsend, Assistant Director, Water Efficiency Labelling and Standards (WELS), authorised delegate of the Regulator, pursuant to section 25 of the Water Efficiency Labelling and Standards Act 2005 (the WELS Act), register the following WELS product(s) under subsection 28(1) of the WELS Act. WELS registrations are subject to the conditions set out in subsections 4.5, 4.6 and 4.7 of AS/ANZ 6400:2005 Water efficient products–Rating and labelling.

Overview

The Water Efficiency Labelling and Standards Act 2005 (the WELS Act) was enacted to address the problem of water wastage through inefficient water-using products, and to encourage consumers and industry to adopt more water-efficient products. This Act was passed by the Parliament of Australia, with the policy objective of improving water efficiency across the nation by setting standards and labels for water-using products. The legislation facilitates the registration of water-efficient products by the Water Efficiency Labelling and Standards (WELS) Regulator, ensuring that only products that meet certain efficiency criteria are allowed to carry the WELS label. This measure aims to provide consumers with clear and reliable information on the water efficiency of products, thereby encouraging more sustainable water use practices.

Scope and Application

The Water Efficiency Labelling and Standards Act 2005 (WELS Act) applies to water-using products sold in Australia, ensuring these products meet certain water efficiency standards. This Act is a Commonwealth legislation that imposes requirements on manufacturers, importers, and retailers of water-using products, including taps, showers, and clothes washing machines. The Act mandates that these products must be labelled with a Water Efficiency Label (WEL) that indicates their water efficiency rating, thereby allowing consumers to make informed choices about water-efficient products. The scope of the Act encompasses a wide range of products, but it does not apply to all types of water-using devices, with specific exclusions outlined in the Act. The application of the WELS Act is further extended through subordinate instruments, which detail the specific water efficiency standards and rating criteria for different product categories. The Act does not apply to products that are not sold in Australia or to those that do not fall within the defined product categories subject to water efficiency labelling.

Key Provisions

The Water Efficiency Labelling and Standards Act 2005 (WELS Act) sets out the legislative framework for the registration and labelling of water-efficient products in Australia. Section 28(1) of the Act mandates the registration of water-efficient products, which must meet the criteria outlined in the Australian/New Zealand Standard 6400:2005 (subsections 4.5, 4.6 and 4.7). The products must be assessed for their water efficiency and labelled appropriately. For example, in the case of corporations, the maximum penalty can be up to several hundred thousand Australian dollars. Additionally, individuals who are officers of the corporation and are involved in the management or decision-making processes that lead to the contravention may also face personal penalties. These provisions underscore the importance of compliance with the Act and the potential legal ramifications of non-compliance.
