THE WATER EFFICIENCY LABELLING AND STANDARDS REGULATOR

NOTICE UNDER SUBSECTION 28(1) OF THE

WATER EFFICIENCY LABELLING AND STANDARDS ACT 2005

 

I,  Josephine Townsend, Assistant Director, Water Efficiency Labelling and Standards (WELS), authorised delegate of the Regulator, pursuant to section 25 of the Water Efficiency Labelling and Standards Act 2005 (the WELS Act), register the following WELS product(s) under subsection 28(1) of the WELS Act.  WELS registrations are subject to the conditions set out in subsections 4.5, 4.6 and 4.7 of AS/ANZ 6400:2005 Water efficient products–Rating and labelling.

Overview

The Water Efficiency Labelling and Standards Act 2005 was enacted to address the need for standardised water efficiency ratings and labelling for products sold in Australia. This legislation was introduced to promote water conservation and efficiency by providing consumers with clear and comparable information on the water usage of products. The Act aims to reduce overall water consumption by encouraging the use of more water-efficient products. The enacting body for this Act is the Parliament of Australia, with the policy objective of improving water efficiency across various sectors by providing a consistent labelling system that informs consumers and influences purchasing decisions. This Act established the Water Efficiency Labelling and Standards Regulator, which is responsible for the administration and enforcement of the labelling requirements. The Regulator ensures that products meet the specified water efficiency standards and that manufacturers comply with the labelling regulations. Through the registration of products with water efficiency ratings and labels, the Act helps consumers make informed choices that contribute to the broader goal of conserving water resources in Australia.

Scope and Application

The Water Efficiency Labelling and Standards Act 2005 governs the water efficiency labelling and standards regime in Australia, and applies to products, entities, and industries that deal with water-efficient products. This Act is a Commonwealth legislation, and it extends to the entire country, ensuring uniform standards across all states and territories. The Act requires that certain water-using products, such as taps, showerheads, and washing machines, must be registered and display a Water Efficiency Label (WEL) indicating their water efficiency rating. The Act applies to products manufactured or supplied within Australia and also to imported products, ensuring that all water-using products in the market meet a certain level of water efficiency. The application of the Act is comprehensive, covering a wide range of products, with some exclusions such as products that are not primarily water-using. The Act also allows the Regulator to extend or restrict the application of the standards through subordinate instruments, ensuring the regime remains dynamic and responsive to technological advancements and market changes.

Key Provisions

The Water Efficiency Labelling and Standards Regulator Notice under subsection 28(1) of the Water Efficiency Labelling and Standards Act 2005 (WELS Act) details the registration of various water-efficient products. Specifically, it provides for the registration of products such as tap and tap outlet sets, clothes washing machines, showers, and toilet suites under the Water Efficiency Labelling and Standards (WELS) scheme (subsection 28(1)). These registrations are contingent on compliance with the conditions outlined in subsections 4.5, 4.6, and 4.7 of AS/ANZ 6400:2005 Water efficient products–Rating and labelling. Each product is identified by its brand name, product type, family name or model reference, and a unique registration number. The Act imposes several obligations on the parties or entities it governs, including the requirement for products to meet specified water efficiency standards to be registered under the WELS scheme. Manufacturers and importers must ensure their products comply with the relevant standards and criteria set out by the WELS Act. Additionally, the Act mandates that the products must be accurately labelled with a WELS rating, which provides consumers with information about the product's water efficiency. Failure to comply with the provisions of the WELS Act can lead to various consequences. Breaches of the Act may result in civil penalties, which can be substantial. For example, section 34 of the WELS Act allows for fines of up to $33,000 for individuals and $165,000 for bodies corporate. Additionally, the Act may provide for criminal penalties in certain circumstances, although the specific criminal provisions and penalties are not detailed in this notice. Non-compliance can also lead to product recalls, injunctions, and other enforcement actions by the Regulator.
