THE WATER EFFICIENCY LABELLING AND STANDARDS REGULATOR

NOTICE UNDER SUBSECTION 28(1) OF THE

WATER EFFICIENCY LABELLING AND STANDARDS ACT 2005

 

I,  Josephine Townsend, Assistant Director, Water Efficiency Labelling and Standards (WELS), authorised delegate of the Regulator, pursuant to section 25 of the Water Efficiency Labelling and Standards Act 2005 (the WELS Act), register the following WELS product(s) under subsection 28(1) of the WELS Act.  WELS registrations are subject to the conditions set out in subsections 4.5, 4.6 and 4.7 of AS/ANZ 6400:2005 Water efficient products–Rating and labelling.

Overview

The Water Efficiency Labelling and Standards Act 2005 was enacted by the Commonwealth Parliament to address the issue of water wastage in Australia. This legislation established a mandatory water efficiency labelling scheme for various products, including taps, showerheads, cisterns, and dishwashers, to inform consumers about the water efficiency of these items. The policy objective was to reduce water consumption and promote the adoption of water-efficient products across the nation. The Act was designed to empower consumers with knowledge about the water efficiency of products, thereby encouraging the purchase of items that contribute to water conservation efforts. The Water Efficiency Labelling and Standards Act 2005 provides the legislative framework for the mandatory labelling of products based on their water efficiency ratings. By requiring manufacturers and importers to label their products with water efficiency ratings, the Act aims to increase consumer awareness and drive the market towards more water-efficient products. The Act also establishes the Water Efficiency Labelling and Standards Regulator, which is responsible for the administration and enforcement of the labelling scheme, ensuring compliance and promoting water conservation across Australia.

Scope and Application

The Water Efficiency Labelling and Standards (WELS) Act 2005 applies to entities and products involved in the manufacture, import, or supply of water-efficient products in Australia. The Act aims to ensure that consumers are provided with clear and accurate information about the water efficiency of various products, thereby promoting water conservation. The Act applies to a broad range of water-efficient products, including tapware, cisterns, dishwashers, and flow controllers. It mandates that these products bear a WELS label if they meet specified water efficiency standards. The Act's application extends across the Commonwealth of Australia, making it a national legislation. However, the Act does not apply to products that have been specifically exempted under the subordinate instruments, which can include certain types of products or circumstances where water efficiency standards do not apply. The Act’s requirements are enforced through the registration of products, and these registrations are subject to conditions outlined in the Australian/New Zealand Standard AS/ANZ 6400:2005. The scope of the Act can be further extended or modified through regulations made under the authority of the Act.

Key Provisions

The Water Efficiency Labelling and Standards Regulator Notice under subsection 28(1) of the Water Efficiency Labelling and Standards Act 2005 provides a formal registration of water-efficient products by the Regulator. This registration includes specific brands and models of tapware, flow controllers, cisterns, shower sets, and dishwashers, each identified by their family name, product name, or model reference. These products have been evaluated and registered under the Water Efficiency Labelling and Standards Act 2005 (WELS Act) to ensure they meet the required water efficiency standards (subsections 4.5, 4.6, and 4.7 of AS/ANZ 6400:2005). Each product receives a unique registration number, which serves as evidence of compliance with the Act’s standards. The Act imposes specific obligations on manufacturers, importers, and suppliers of water-efficient products. These parties must ensure that their products are tested and certified by accredited bodies before being marketed or sold in Australia. They must also maintain records of the testing and certification processes. Suppliers must ensure that the products they supply bear the correct WELS label, which indicates the product’s water efficiency rating. Furthermore, manufacturers and importers must comply with any conditions set out by the Regulator as part of the registration process, which may include specific labelling requirements or ongoing monitoring of product performance. Failure to comply with the provisions of the WELS Act can result in significant penalties and legal consequences. Under section 47 of the Act, a person who contravenes the Act may be liable to a civil penalty of up to $66,000 for each offence. Additionally, the Act provides for criminal penalties for serious or repeated breaches. For example, section 51 of the Act outlines penalties for knowingly supplying a non-compliant product, with maximum fines of up to $220,000 for individuals and $1,100,000 for corporations. These penalties underscore the importance of compliance with the WELS Act and the severe consequences that can result from non-compliance.
