  This instrument may be cited as Radiocommunications Standards (Electromagnetic Compatibility) No. 1 of 1996.

2 Interpretation

 (1) In this instrument, unless the contrary intention appears:

  ISM equipment means equipment that is designed or intended for the purpose of generating, or using locally, radiofrequency energy for scientific, medical, domestic or industrial purposes.

light industrial purposes, in relation to equipment, means industrial purposes that are achieved by the direct connection of the equipment to:

 (a) a low voltage mains electricity supply; or

 (b) a dedicated DC source that is intended to interface between the equipment and a low voltage mains electricity supply.

LISM equipment means equipment that is designed or intended for the purpose of generating, or using locally, radiofrequency energy for scientific, medical, domestic or light industrial purposes.

low voltage means a voltage in the range 230V to 250V (inclusive).

the Act means the Radiocommunications Act 1992.

 (2) In this instrument, a reference to an Australian/New Zealand Standard is a reference to the Standard as in force from time to time.

3 Devices to which this instrument does not apply

  This instrument does not apply to the following devices:

 (a) a radiocommunications transmitter;

 (b) a device that complies with a radio emission standard (other than a standard that applies to the device in accordance with this instrument) that applies to the device under a law of the Commonwealth or of a State or Territory;

 (c) a device that is the prototype of a device that is intended to be available in Australia;

 (d) a device that is used only for exhibition.

4 Application of standards to complex devices

 (1) Subclause (2) applies to a device that is imported or manufactured in, or altered or modified into, a form that:

 (a) contains 2 or more devices (component devices); and

 (b) is not part of a larger device.

 (2) When the device is imported, manufactured, altered or modified:

 (a) the component devices are taken to be 1 device (a complex device) for this instrument; and

 (b) the only standard determined for the complex device is the standard applicable to the composite form of the complex device; and

 (c) no standard applies to a component device in that capacity.

5 Standard for sound and television broadcast receivers and associated equipment

 (1) This clause applies to the performance, in the frequency band 9 kHz to 1 GHz, of a device:

 (a) that is:

 (i) a video recorder; or

 (ii) a video playback machine; or

 (iii) a sound or television receiver, designed or intended to receive broadcast transmissions and other similar transmissions; and

 (b) that is:

 (i) designed or intended to be directly or indirectly connected to a low voltage mains electricity supply for the purpose of operating the device or charging a battery that is used to operate the device; or

 (ii) designed or intended to be operated by a battery.

 (2) For the purposes of paragraph 162 (1) (a) of the Act, the standard for the performance of the device is the standard set out in Australian/New Zealand Standard AS/NZS 1053:1992, other than clause 1.

6 Standard for industrial, scientific and medical radio-frequency equipment

 (1) Subject to subclause (2), this clause applies to the performance, in the frequency band 9 kHz to 400 GHz, of:

 (a) spark erosion equipment; and

 (b) LISM equipment in which conductively coupled electromagnetic energy that is necessary for the internal functioning of the equipment is intentionally generated or used, including the equipment of that kind specified in Part 1 of Schedule 1; and

 (c) ISM equipment in which electromagnetic energy is intentionally generated, or used in the form of electromagnetic radiation for the purpose of treating material, including equipment of that kind:

 (i) specified in Part 2 of Schedule 1; or

 (ii) designed or intended for a purpose described in Part 3 of that Schedule.

 (2) This clause does not apply to:

 (a) tungsten ignited gas welders; or

 (b) a device to which clause 5 applies.

 (3) For the purposes of paragraph 162 (1) (a) of the Act, the standard for the performance of the devices is the standard set out in Australian/New Zealand Standard AS/NZS 2064.1:1992 and Australian/New Zealand Standard AS/NZS 2064.2:1992, other than:

 (a) subclauses 1.1, 1.3, 1.4 and 4.2 of Australian/New Zealand Standard AS/NZS 2064.1:1992; and

 (b) clause 1 of Australian/New Zealand Standard AS/NZS 2064.2:1992.

 (4) For the application of those Standards:

 (a) a device is class A equipment, and must comply with the class A limits set out in the Standards, if it is not designed or intended to be directly or indirectly connected to a low voltage mains electricity supply; and

 (b) a device is class B equipment, and must comply with the class B limits set out in the Standards, if it is designed or intended to be directly or indirectly connected to a low voltage mains electricity supply; and

 (c) a device is class B equipment, and must comply with the class B limits set out in the Standards, if it is designed or intended to be directly or indirectly connected to:

 (i) a low voltage mains electricity supply; and

 (ii) any other kind of electricity supply.

7 Standard for electric motor-operated and thermal appliances for household purposes, electric tools and similar electric apparatus

 (1) Subject to subclause (3), this clause applies to the performance, in the frequency band 9 kHz to 400 GHz, of a device:

 (a) the main functions of which are performed by any of the following:

 (i) electric motors;

 (ii) electric switching or regulating devices; and

 (b) designed or intended to be directly or indirectly connected to a low voltage mains electricity supply for the purpose of operating the device or charging a battery that is used to operate the device.

 (2) Examples of devices to which this clause applies are:

 (a) electric motor-operated appliances that are designed or intended to be used for household or office purposes, including the appliances of that kind specified in Part 1 of Schedule 2;

 (b) motor-operated tools that have 2 rotating directions, electric powered-tools, hand-held (portable) motor-operated tools and transportable (semi-stationary) motor-operated tools, including the tools of those kinds specified in Part 2 of Schedule 2;

 (c) motor-operated electromedical apparatus, including the apparatus of that kind specified in Part 3 of Schedule 2;

 (d) electrical heating appliances, including the appliances of that kind specified in Part 4 of Schedule 2;

 (e) automatic goods-dispensing machines and entertainment machines, including the machines of those kinds specified in Part 5 of Schedule 2;

 (f) electric toys that are operated on tracks, including systems, individual components and individual controllers of those toys;

 (g) electronic gas igniters, including the igniters of that kind specified in Part 6 of Schedule 2;

 (h) radiating equipment that is designed or intended for personal care, including equipment that:

 (i) contains a gas discharge lamp (for example, an ultra-violet lamp or an ozone lamp); and

 (ii) is designed or intended for therapeutic purposes;

 (i) a device specified in Part 7 of Schedule 2.

 (3) This clause does not apply to a device to which clause 5 or 6 applies.

 (4) For the purposes of paragraph 162 (1) (a) of the Act, the standard for performance of a device to which this clause applies is the standard set out in Australian/New Zealand Standard AS/NZS 1044:1995, other than clause 1 and subclauses 7.2.1 and 8.4.

8 Standard for information technology equipment

 (1) Subject to subclause (2), this clause applies to the performance, in the frequency band 9 kHz to 400 GHz, of a device that:

 (a) has any of the following as its primary function in relation to data or telecommunication messages:

 (i) entry;

 (ii) storage;

 (iii) display;

 (iv) retrieval;

 (iv) transmission;

 (vi) processing;

 (vii) switching;

 (viii) control; and

 (b) may be equipped with 1 or more terminal ports typically operated for information transfer; and

 (c) has a rated supply voltage not greater than 600 volts.

 (2) This clause does not apply to a device to which clause 5, 6 or 7 applies.

 (3) For the purposes of paragraph 162 (1) (a) of the Act, the standard for the performance of the device is the standard set out in Australian/New Zealand Standard AS/NZS 3548:1995, other than clause 1 and subclauses 3.1, 4.1 and 4.2.

 (4) For the purposes of the application of that Standard:

 (a) telecommunications equipment is class A ITE, and must comply with the class A ITE limits set out in the Standard; and

 (b) a device (other than telecommunications equipment) is class B ITE, and must comply with the class B ITE limits set out in the Standard, if:

 (i) it is intended for household use; or

 (ii) it has no fixed place of use; or

 (iii) it is a personal computer; or

 (iv) it is auxiliary equipment that is, or is intended to be, connected to a personal computer; and

 (c) any other device is class A ITE, and must comply with the class A ITE limits set out in the Standard.

 (5) Paragraph (4) (a) ceases to have effect at the end of 31 December 1997.

9 Standard for electrical lighting and similar equipment

 (1) Subject to subclause (2), this clause applies to the performance, in the frequency band 9 kHz to 400 GHz, of a device that:

 (a) is:

 (i) a device that has a primary function of generating or distributing light for the purpose of illumination, including the equipment of that kind specified in Schedule 3; or

 (ii) independent auxiliaries used exclusively with a device referred to in subparagraph (i); and

 (b) is designed or intended to be directly or indirectly connected to a low voltage mains electricity supply for the purposes of operating the device or charging a battery that is used to operate the device.

 (2) This clause does not apply to a device to which clause 6 or 7 applies.

 (3) For the purposes of paragraph 162 (1) (a) of the Act, the standard for the performance of the device is the standard set out in Australian/New Zealand Standard AS/NZS 4051:1994, other than clause 1.

10 Standard for internal combustions engines and associated devices

 (1) Subject to subclauses (2), this clause applies to the performance of a device the main functions of which are performed by:

 (a) internal combustion engines that are designed or intended to propel a vehicle; or

 (b) spark ignited internal combustion engines.

 (2) This clause does not apply to:

 (a) a part of:

 (i) an aircraft; or

 (ii) a railway traction system; or

 (iii) an incomplete vehicle; or

 (iv) a vehicle that is registered, or that is of a kind capable of being registered, under a law of the Commonwealth or of a State or Territory for use on a public road; or

 (b) a device to which clause 6 or 9 applies.

 (3) For the purposes of paragraph 162 (1) (a) of the Act, the standard for the performance of the device is the standard set out in Australian/New Zealand Standard AS/NZS 2557:1992, other than clause 1.

11 Standard for residential, commercial and light industry devices

 (1) Subject to subclause (2), this clause applies to the performance, in the frequency band 0 Hz to 400 GHz, of electrical and electronic equipment that is designed or intended to be directly connected to:

 (a) a low voltage mains electricity supply; or

 (b) a dedicated DC source that is intended to interface between the equipment and a low voltage mains electricity supply.

Note   This clause is intended to apply to equipment that would operate in a residential, commercial or light-industrial environment.

 (2) This clause does not apply to a device to which clause 5, 6, 7, 8, 9 or 10 applies.

 (3) For the purposes of paragraph 162 (1) (a) of the Act, the standard for the performance of the equipment is the standard set out in Australian/New Zealand Standard AS/NZS 4251.1:1994, other than:

 (a) clauses 1 and 5; and

 (b) The entry in the second row of the column headed Basic Standard in the table headed Table 1:Emission.

12 Standard for measuring levels of radio emissions

  The performance of a device to which an Australian/ New Zealand Standard applies in accordance with this instrument must be measured in accordance with the arrangements in the relevant standard.

13 Revocation of Ministerial Standard Adopting AS2064‑1977 (Standard under the Radiocommunications Act 1983)

  Statutory Rules 1985 No. 339 are revoked.

Overview

The Radiocommunications Standards (Electromagnetic Compatibility) No. 1 of 1996 was enacted to address the need for consistent standards to manage electromagnetic interference (EMI) caused by various electronic and electrical devices. This statutory rule was made under the Radiocommunications Act 1992 by the Australian Government and is intended to ensure that devices operating within the radiocommunications spectrum do not cause unacceptable interference to other devices or services. The policy objective is to maintain the integrity of radiocommunications services while promoting the safe and efficient use of the radio spectrum. The standards outlined in this legislation aim to balance the needs of various industries with the necessity to limit EMI, thereby facilitating technological advancement while preserving the functionality of critical communication systems.

Scope and Application

The Radiocommunications Standards (Electromagnetic Compatibility) No. 1 of 1996 governs the electromagnetic compatibility of various types of devices under the Radiocommunications Act 1992. This legislation applies to the performance of a broad range of devices, including sound and television broadcast receivers, industrial, scientific, and medical radio-frequency equipment, electric motor-operated appliances, information technology equipment, electrical lighting, internal combustion engines, and residential, commercial, and light industry devices. These devices must comply with specific standards set out in various Australian/New Zealand Standards to ensure they do not emit excessive electromagnetic interference. The Act applies to devices imported or manufactured in Australia, but excludes certain devices such as radiocommunications transmitters, prototypes, and exhibition devices. The application of these standards is further nuanced by specific exclusions and exemptions, such as devices already complying with other radio emission standards or those used solely for exhibition purposes. Additionally, the Act provides for the application of standards to complex devices, which are treated as a single entity when they contain multiple component devices. The standards applicable to these devices are those that pertain to the composite form of the complex device, with no individual standards applying to the component devices in that capacity. The Act also revokes a previous Ministerial Standard and mandates that the performance of devices be measured in accordance with the relevant Australian/New Zealand Standards.

The Radiocommunications Standards (Electromagnetic Compatibility) No. 1 of 1996, made under the Radiocommunications Act 1992, outlines the standards for electromagnetic compatibility (EMC) for various devices. For instance, Clause 5 sets the standard for sound and television broadcast receivers and associated equipment to comply with AS/NZS 1053:1992. Clause 7 requires electric motor-operated and thermal appliances for household purposes, electric tools, and similar electric apparatus to adhere to AS/NZS 1044:1995. Clause 8 stipulates that information technology equipment must comply with AS/NZS 3548:1995, with distinctions made between telecommunications equipment and other devices. Clause 9 sets the standard for electrical lighting and similar equipment to comply with AS/NZS 4051:1994. Clause 10 mandates that internal combustion engines and associated devices comply with AS/NZS 2557:1992. Lastly, Clause 11 requires residential, commercial, and light industry devices to adhere to AS/NZS 4251.1:1994. These provisions impose obligations on manufacturers, importers, and suppliers of the specified devices to ensure compliance with the relevant EMC standards. Compliance includes proper design, manufacturing, and testing of devices to meet the specified standards. The legislation also requires that any device not meeting these standards must not be imported or manufactured in Australia. Additionally, devices must be accompanied by appropriate documentation attesting to their compliance with the relevant standards. The Act imposes penalties for non-compliance. The Radiocommunications Act 1992, under which this legislation is made, includes provisions for civil and criminal penalties for breaches. Specifically, individuals or entities found to be in breach of the EMC standards may be subject to fines. The maximum penalties can be significant, depending on the severity and frequency of the breach. The Act empowers authorised officers to enforce compliance, including the power to seize non-compliant devices and issue infringement notices. Furthermore, persistent or egregious non-compliance can lead to criminal charges, resulting in more severe penalties, including substantial fines and potential imprisonment.
