Overview

The Radiocommunications (Licensing and General) Regulations 2 were enacted in 1992 by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, under the Radiocommunications Act 1983. These regulations were introduced to address specific gaps and issues within the licensing framework for radiocommunications services in Australia. The primary objective of these amendments was to refine and update the regulatory landscape to better cater to the evolving technological and commercial needs of the industry. The amendments introduced include adjustments to the interpretation of certain terms within the regulations and the introduction of new provisions related to the allocation system for multipoint distribution station licenses, as per section 92A of the Act.

Scope and Application

The Radiocommunications (Licensing and General) Regulations 1992, amended in 1992, apply to entities and persons engaged in radiocommunications within the Commonwealth of Australia, including the use of radio spectrum and the operation of radiocommunication apparatus. The Regulations are made under the Radiocommunications Act 1992 and govern the licensing and general aspects of radiocommunications activities. They are applicable to a wide range of industries that rely on radiocommunications, such as broadcasting, telecommunications, and emergency services. The Regulations provide a framework for the allocation of radio spectrum, the issuance of licences, and the compliance with standards set to ensure the efficient and safe use of the radio spectrum. The scope of the Regulations extends nationally across Australia, encompassing all states and territories, and they are subject to modifications through subordinate instruments as required to keep up with technological advancements and industry needs.

Key Provisions

The main operative sections of these Regulations are the commencement date (section 1), the amendment of existing regulations (section 2), and the introduction of a new regulation (section 4). Specifically, section 1.1 sets the date on which these Regulations take effect, 5 October 1992. Section 2.1 indicates that the existing Radiocommunications (Licensing and General) Regulations are amended by these Regulations. Section 4.1 introduces a new regulation, Regulation 12a, which deals with the allocation system for Multipoint Distribution Station Licences under section 92a of the Radiocommunications Act 1992. This new regulation provides that a licence for a multipoint distribution station, as described in Schedule 1, can have its price-based allocation system determined by the Minister. The obligations and requirements imposed by these Regulations primarily pertain to the licensing and management of radiocommunications. The amendments and new regulations require that the Minister has the authority to determine the allocation system for certain types of licences. Specifically, Regulation 12a mandates that the Minister may establish a price-based allocation system for licences related to multipoint distribution stations. This requirement ensures that the Minister can regulate the allocation of spectrum resources in a manner that is both efficient and responsive to market conditions. Failure to comply with the provisions of these Regulations may result in civil or criminal penalties, depending on the nature and severity of the breach. Under the Radiocommunications Act 1992, breaches of the regulations may lead to fines or other penalties as prescribed by law. The exact penalties are not detailed in the Regulations themselves but would be determined in accordance with the broader legislative framework established by the Act and other relevant laws. The Minister's ability to determine the allocation system under the new Regulation 12a is intended to provide flexibility in managing radiocommunications resources while ensuring compliance with legislative requirements.
