Radiocommunications (Infrared Devices) Class Licence 2002

The AUSTRALIAN COMMUNICATIONS AUTHORITY issues this Class Licence under subsection 132 (1) and section 135 of the Radiocommunications Act 1992.

1 Name of Class Licence

  This Class Licence is the Radiocommunications (Infrared Devices) Class Licence 2002.

2 When Class Licence comes into force

  This Class Licence comes into force on gazettal.

3 Definitions

  In this Class Licence:

Act means the Radiocommunications Act 1992.

device compliance day, for an infrared device, means the most recent of the following days:

 (a) if the infrared device was manufactured in Australia — the day the infrared device was manufactured;

 (b) if the infrared device was manufactured overseas and imported — the day it was imported;

 (c) if the infrared device was altered or modified in a material respect — the day it was altered or modified.

infrared device means a radiocommunications device having a radio emission in the frequency range 187.5 THz to 420 THz.

Note   For definitions of other expressions used in this Class Licence, see the Act, the Radiocommunications Regulations 1993 and the Radiocommunications (Interpretation) Determination 2000.

4 Revocation

  For section 135 of the Act, the following instruments are revoked:

  • Radiocommunications Class Licence (Infrared Devices), notified in the Gazette on 24 July 1996
  • Radiocommunications Class Licence (Infrared Devices) Amendment (No. 1) 1998, notified in the Gazette on 8 July 1998.

5 Class Licence

  Subject to sections 6, 7 and 8, this Class Licence authorises any person to operate an infrared device.

6 Condition — output power

  The output power of an infrared device to which this Class Licence applies must not be more than 125 mW.

7 Condition — interference

  The operation of an infrared device to which this Class Licence applies must not cause interference to another radiocommunications device.

Note 1   An infrared device will not be afforded protection from interference caused by other radiocommunications devices.

An infrared device operated under this Class Licence is generally not expected to suffer interference. However, an individual infrared device may experience, from other radiocommunications devices, interference arising from the particular circumstances of the operation of the infrared device.

Note 2   Australia/New Zealand Standard AS/NZS 2211.1:1997 details the requirements necessary to protect persons from radiation from laser devices, many types of which are authorised by this Class Licence.

8 Standards

  If the device compliance day for an infrared device to which this Class Licence applies occurs on or after the day on which this Class Licence comes into force, the infrared device must comply with any standard applicable to it as in force on that day.

Note 1   The ACA wishes to make it clear that if a standard mentioned in this section is amended or replaced by another standard following the device compliance day for the infrared device, the infrared device need not comply with the amended or replaced standard.

Note 2   Section 5 of the Act defines standard to mean a standard made under section 162 of the Act.

It is important to note that while this Class Licence sets out the general conditions for operating infrared devices, it does not exempt infrared devices from potential interference caused by other radiocommunications devices, which may arise under specific operational circumstances.

Key Provisions

The Radiocommunications (Infrared Devices) Class Licence 2002 (the Licence) authorises any person to operate an infrared device, subject to certain conditions. Section 5 of the Licence outlines that this authority is granted under the Radiocommunications Act 1992 (the Act) and supersedes previous licences related to infrared devices.
