Overview

The Queensland Heavy Vehicle Standards (Agricultural Vehicles) Exemption Notice 2021 (No.1) was enacted to address specific concerns related to the practical use of agricultural vehicles in Queensland. This Notice was made under section 61 of the Heavy Vehicle National Law (HVNL) as in force in Queensland, with the objective of providing exemptions from certain lighting and braking requirements for agricultural vehicles. By exempting these vehicles from certain standards, the Notice aims to balance the need for road safety with the practical requirements of agricultural operations. The Notice applies to agricultural implements, machines, and implements being towed by registered vehicles in Queensland and is set to commence on 5 July 2021, expiring on 30 June 2026. It provides specific conditions under which agricultural vehicles can operate without complying with particular vehicle standards, thereby facilitating the efficient operation of agricultural activities within the state.

Scope and Application

The Queensland Heavy Vehicle Standards (Agricultural Vehicles) Exemption Notice 2021 (No.1) applies to agricultural vehicles within the jurisdiction of Queensland, providing specific exemptions from certain lighting and braking requirements stipulated under the Heavy Vehicle National Law (HVNL). This Notice primarily concerns agricultural implements and machines, including those being towed by registered vehicles that are fit for towing purposes. The exemptions pertain to vehicles with conditional registration, as defined by the Transport Operations (Road Use Management – Vehicle Registration) Regulation 2010. The Notice outlines exemptions for various vehicle standards, such as tail-lights, clearance lights, side marker lights, reflectors, brake lights, direction indicator lights, and braking systems, contingent upon conditions such as the vehicle's location code, operational hours, and speed limits. Additionally, the Notice permits the attachment of lights and reflectors in a retractable or removable manner to prevent damage when used off-road. This exemption notice is in force from 5 July 2021 until 30 June 2026.

Key Provisions

The main operative sections of the Queensland Heavy Vehicle Standards (Agricultural Vehicles) Exemption Notice 2021 (No.1) pertain to exemptions from certain lighting and braking requirements for agricultural vehicles. Section 8 outlines the exemptions from the prescribed vehicle standards listed in the Heavy Vehicle (Vehicle Standards) National Regulation. These exemptions apply to agricultural implements and machines, as well as agricultural implements being towed by registered vehicles (section 7). Specifically, the exemptions cover tail-lights, clearance lights, side marker lights, reflectors, brake lights, direction indicator lights, and heavy trailer braking systems, subject to specific conditions such as the type of vehicle towing the implement, speed limits, and location codes (section 8 and Table 1). The Notice imposes obligations on the parties it governs, primarily agricultural vehicle operators and owners. Agricultural implements and machines must comply with the conditions specified in Table 1 to qualify for the exemptions. This includes ensuring that conditionally registered vehicles towing agricultural implements comply with location codes and limitations, and that the lights of the towing vehicle are not obscured by the implement (section 8). Additionally, lights or reflectors required by this Notice may be attached in a retractable or removable manner to prevent damage when the implement is used off-road (section 9). Breach of the provisions in this Notice may lead to civil and criminal consequences. Although specific offences and penalties are not detailed within the text provided, it is reasonable to infer that non-compliance with the exemptions and conditions could result in fines, vehicle impoundment, or other legal actions as per the general provisions of the Heavy Vehicle National Law. The maximum penalties would depend on the specific nature and severity of the breach, as well as any applicable state or territory laws. Operators and owners of agricultural vehicles should ensure they are fully aware of and adhere to the requirements to avoid potential legal repercussions.
