National Heavy Vehicle Regulator

Overview

The Heavy Vehicle National Law (HVNL) was enacted to harmonise heavy vehicle regulation across Australia, aiming to address issues of safety and efficiency in the transportation of goods and people. The Queensland Class 3 Timber Transportation Mass Exemption Notice 2024 (No. 1) was introduced by the Queensland Parliament to provide mass exemptions for heavy vehicles transporting timber from the point of felling to sawmills and other processing facilities. The purpose of this notice is to facilitate the movement of timber in a way that accommodates the unique requirements of the timber industry while ensuring safety and compliance with national standards. The policy objective is to streamline the transportation process for timber, thereby supporting the forestry sector by reducing regulatory burdens. This notice, effective from 1 July 2024, sets out specific mass limits and conditions for eligible vehicles transporting timber within Queensland until 30 May 2029.

Scope and Application

The Queensland Class 3 Timber Transportation Mass Exemption Notice 2024 (No.1) applies to Class 3 heavy vehicles in Queensland, including rigid trucks, combinations consisting of a rigid truck towing a dog trailer, combinations consisting of a prime mover towing a semi-trailer, B-doubles, and road trains, provided they are transporting timber from the place where it was felled to a timber receiver. The notice exempts these eligible vehicles from certain mass requirements under the Heavy Vehicle (Mass Dimension and Loading) National Regulation, but only to the extent specified in sections 9 and 10 of the notice. It allows for a gross combination mass of up to 7.5% above the limit set in the MDL Regulation, provided the manufacturer's mass limits are not exceeded. The notice also stipulates specific mass limits for different types of axle groups, with steer axles having a maximum limit of 7.1t for road trains and 6.6t for other vehicles. All eligible vehicles must be fitted with functional and accurate onboard mass measurement scales, unless they deliver timber to a facility with a certified weighbridge. The notice applies to all state-controlled roads in Queensland and requires compliance with road, travel, and vehicle conditions as per the Heavy Vehicle National Law.

Key Provisions

The Queensland Class 3 Timber Transportation Mass Exemption Notice 2024 (No.1) (the "Notice") primarily exempts certain heavy vehicles transporting timber from specific mass requirements as outlined in sections 2, 4, and 5 of Schedule 1 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation (MDL Regulation). Section 8 of the Notice specifies that this exemption applies only to the extent that the mass limits are provided in sections 9 and 10. It is important to note that the more restrictive mass limit applies if more than one limit is prescribed for a particular vehicle or component. However, regardless of these exemptions, the vehicle must not exceed the manufacturer's mass limits as defined in section 8(8) of the MDL Regulation. The Notice imposes several conditions on eligible vehicles, which include vehicles transporting timber from the place where it was felled to a timber receiver. According to section 9, an eligible vehicle may have a gross combination mass equal to the mass it would be eligible for under section 2 of Schedule 1 of the MDL Regulation, plus an additional 7.5%. Section 10 further stipulates that an axle group on an eligible vehicle may have a mass equal to the mass it would be eligible for under sections 4 and 5 of Schedule 1 of the MDL Regulation, plus 10%, except for the steer axle which has specific limits. Additionally, section 11 requires that all axles on an eligible vehicle, except for the steer axle, must have a minimum of four tyres. Section 12 mandates that eligible vehicles must be fitted with on board mass measurement scales, unless the vehicle is delivering timber to a timber receiver that has a certified weighbridge. Breaches of the Notice can result in civil and criminal consequences. Under the Heavy Vehicle National Law (HVNL), any failure to comply with the conditions of this Notice can lead to penalties. Although specific penalties are not detailed in the Notice, the HVNL generally provides for fines and potential disqualification from driving heavy vehicles. The severity of the penalty can depend on the nature and extent of the breach, with more serious offences potentially leading to higher fines and longer disqualification periods. The Notice operates within the framework of the HVNL, and therefore, penalties would be in accordance with the provisions of that law.
