Overview

The Queensland Class 3 Timber Transportation Mass Exemption Notice 2023 (No.1), enacted under Section 117 of the Heavy Vehicle National Law (HVNL), provides mass exemptions for heavy vehicles transporting timber from the place where it is felled to sawmills and other processing facilities in Queensland. This Notice replaces the former Class 3 Permit No.147-TH-14 Mass exemption for the Transport of Log Timber (Queensland) that expires on 31 December 2022. The policy objective is to streamline the transportation of timber while maintaining safety and compliance standards. The Notice sets conditional mass limits, mandates on-board mass measurement scales for compliance, and restricts application to state-controlled roads. The exemption applies to class 3 heavy vehicles transporting timber directly from the felling site to a timber receiver, including rigid trucks, combinations, and road trains, and is effective from 1 January 2023 until 30 June 2024.

Scope and Application

The Queensland Class 3 Timber Transportation Mass Exemption Notice 2023 (No.1), issued under the Heavy Vehicle National Law (HVNL), provides mass exemptions for certain heavy vehicles transporting timber from the place where it is felled to sawmills or other timber processing facilities. This Notice applies to specific types of class 3 heavy vehicles, including rigid trucks, combinations of a rigid truck towing a dog trailer, combinations of a prime mover towing a semi-trailer, B-doubles, and road trains, provided they are transporting timber directly to a timber receiver. It is applicable solely to state-controlled roads in Queensland and is effective from 1 January 2023 until 30 June 2024. The exemption from prescribed mass requirements is conditional, with specific mass limits and conditions pertaining to the total mass of the vehicle, mass limits for types of axle groups, and requirements for on-board mass measurement scales. These exemptions are limited by conditional mass limits and only apply to state-controlled roads, ensuring compliance with road and vehicle conditions.

Key Provisions

The Queensland Class 3 Timber Transportation Mass Exemption Notice 2023 (No.1) grants exemptions from certain mass requirements for eligible vehicles transporting timber from the felling site to sawmills or other processing facilities. This exemption applies to class 3 heavy vehicles, which include rigid trucks, combinations of a rigid truck towing a dog trailer, a prime mover towing a semi-trailer, B-doubles, and road trains (sections 7 and 8). The mass exemptions are conditional and apply only on state-controlled roads in Queensland (sections 6 and 11). Eligible vehicles are those transporting timber from the felling site directly to a timber receiver (sections 7 and 8). The Notice imposes several conditions to ensure safe transportation. The gross combination mass of an eligible vehicle may be up to 7.5% over the limits set by the Heavy Vehicle (Mass Dimension and Loading) National Regulation, provided the vehicle complies with other specified conditions (section 9). Mass limits for axle groups are generally 10% over the regulation limits, but steer axles have specific limits: 7.1 tonnes for road trains with steer axle tyres of 375mm or more, and 6.6 tonnes for other eligible vehicles (section 10). Furthermore, all axles except the steer axle must have at least four tyres (section 12). Eligible vehicles must also be fitted with functional and accurate on-board mass measurement scales unless delivering to a timber receiver with a certified weighbridge (section 13). Violations of the conditions set out in the Notice can lead to various consequences. The Heavy Vehicle National Law and its regulations outline the offences and penalties for breaches. Generally, these can include fines, disqualification from driving, and potential criminal charges. The exact penalties depend on the severity and circumstances of the breach, with maximum penalties varying for different offences. It is essential for operators to comply with all conditions to avoid any legal repercussions.
