Overview

The Queensland Class 1 Heavy Vehicle Port of Brisbane Derestriction Dimension Exemption Amendment (Notice) 2014 (No. 1), enacted under the Heavy Vehicle National Law, aims to address the logistical challenges associated with transporting oversized and overweight vehicles through the Port of Brisbane. This notice was authorised by the National Heavy Vehicle Regulator and was made under Section 117 and Section 23 of Schedule 1 of the Heavy Vehicle National Law. The primary objective is to facilitate the efficient movement of eligible vehicles within the specified precinct roads, thereby improving operational efficiency and reducing potential delays. This notice came into effect on the date of publication in the Commonwealth Gazette and is set to expire five years later, providing a temporary exemption to comply with certain dimensional requirements for these vehicles.

Scope and Application

The Queensland Class 1 Heavy Vehicle Port of Brisbane Derestriction Dimension Exemption Amendment (Notice) 2014 (No. 1) amends the requirements of the Guideline for Excess Dimension etc. Form Number 4 (Version 8 February 2013) for eligible vehicles in Queensland, specifically those designated as oversize vehicles or combinations. This notice applies to vehicles that meet the eligibility criteria under the Form 4 Guideline or Form 14 Guideline for vehicles that require a pilot or escort in Queensland. It exempts these eligible vehicles from certain dimension requirements, allowing them to travel at any time on specific roads within the Port of Brisbane precinct, including Howard Smith Drive, Osprey Drive, Kite Street, Port Drive north of the roundabout at Port Gate, and roads within Fisherman Island such as Captain Bishop Bridge, Port Drive, Bishop Drive, Bingera Drive, Whimbrel Street, and Lucinda Drive. This exemption is conditional on the vehicles complying with any conditions of Form 4 not excluded by this notice. The notice is made under Section 117 and Section 23 of Schedule 1 of the Heavy Vehicle National Law, and it commences on the date of publication in the Commonwealth Gazette, expiring five years later.

Key Provisions

The primary operative sections of this notice are sections 9 and 10, which allow eligible vehicles, specifically oversize vehicles or combinations, to travel on certain roads within the Port of Brisbane precinct at any time, subject to specific conditions. Section 9 specifies the roads where the exemption applies, including Howard Smith Drive, Osprey Drive, Kite Street, Port Drive, Captain Bishop Bridge, and roads within Fisherman Island. These roads are part of the Port of Brisbane precinct, and the exemption is limited to eligible vehicles that meet the criteria set out in the notice. Section 10, although not explicitly mentioned in the notice, likely refers to the usual conditions of the Form 4 Guideline that must still be adhered to by the vehicles. The obligations and requirements imposed by this notice are that any eligible vehicle seeking to operate under the exemption must comply with all conditions of Form 4 that are not specifically excluded by this notice. This means that while the notice provides an exemption from certain dimensional restrictions, the vehicles must still meet other regulatory requirements such as those related to pilot or escort services, timing restrictions, and other operational conditions specified in Form 4. Additionally, the notice mandates that the exemption is conditional upon the vehicle meeting all other applicable conditions, ensuring that safety and operational standards are not compromised. Under this notice, any breach of the conditions set out in Form 4 or any failure to comply with the specified conditions of the exemption may result in enforcement actions. The specific penalties for non-compliance are not detailed in this notice but would typically include fines, penalties, and potentially the revocation of the exemption. The Heavy Vehicle National Law (HVNL) provides for various offences related to non-compliance with heavy vehicle regulations, and penalties can include substantial fines and imprisonment for serious violations. The exact penalties would depend on the nature and severity of the breach, as well as the jurisdiction's specific laws and regulations.
