HEAVY VEHICLE NATIONAL LAW

 

QUEENSLAND CLASS 1 HEAVY VEHICLE PORT OF BRISBANE DERESTRICTION DIMENSION EXEMPTION AMENDMENT (NOTICE) 2014 (NO. 1)

 

Purpose

 

  1. The purpose of this notice is to vary the requirements of the Guideline for Excess Dimension etc. Form Number 4 (Version 8 February 2013) subject to the condition specified.

 

Authorising Provision

 

2.       This notice is made under Section 117, and Section 23 of Schedule 1, of the Heavy Vehicle National Law as in force in each participating jurisdiction (HVNL).

 

Title

 

3.       This notice may be cited as the Queensland Class 1 Heavy Vehicle Port of Brisbane Derestriction Dimension Exemption Amendment (Notice) 2014 (No. 1)

 

Commencement

 

4.       This notice commences on the date of publication in the Commonwealth Gazette.

 

Expiry

 

5.       This notice expires five years after publication.

 

Definitions

 

6.       Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the HVNL and the Form 4 Guideline.

 

7.       In this notice—

eligible vehicle means a vehicle eligible to operate under the Form 4 Guideline or Form 14 Guideline

 

Form 4 Guideline means the Guideline for Excess Dimension Vehicles Carrying Indivisible Articles Special Purpose Vehicles  Vehicles that require a Pilot or Escort in Queensland Form Number 4 Version 8 February 2013.

 

Application

 

8.       This notice applies to an eligible vehicle in Queensland.
 

 

 

Conditional amendment of Form 4

 

9.       Notwithstanding section 10 of the Form 4 Guideline, an eligible vehicle that is an oversize vehicle or combination may travel at any time on Port of Brisbane precinct roads, including

a)      Howard Smith Drive;

b)      Osprey Drive;

c)       Kite Street and Port Drive including and north of the roundabout at Port Gate; and

d)      Captain Bishop Bridge and all roads within Fisherman Island, including Port Drive, Bishop Drive, Bingera Drive, Whimbrel Street and Lucinda Drive.

 

It is a condition of this exemption that an eligible vehicle complies with any condition of Form 4 that is not excluded by this notice

 

Declaration

 

I, Sal Petroccitto, delegate of the National Heavy Vehicle Regulator hereby exempt a vehicle to which this notice applies from the prescribed dimension requirements that would otherwise apply to the vehicle, to the extent, and on the conditions set out in this notice.
