Overview

The Quarantine (Animals) Regulations Amendment (No. 1) 1960 is a legislative instrument enacted by the Governor-General, acting on the advice of the Federal Executive Council, to amend existing regulations under the Quarantine Act 1908-1950. This instrument aims to update certain provisions concerning the importation of wool and the treatment of animals, as well as the examination of animals intended for export. The changes seek to refine the regulatory framework and ensure that the importation of animals and animal products aligns with current health and safety standards. These amendments were designed to address any gaps or outdated provisions in the existing regulations, thus facilitating smoother trade processes while maintaining protective measures against the introduction of diseases into Australia.

Scope and Application

The Quarantine (Animals) Regulations, made under the authority of the Quarantine Act 1908-1950, govern the importation of animals, animal products, and related materials into Australia, applying to all persons and entities involved in the importation process. These regulations encompass various animal products such as wool, meat, and edible parts of animals, and mandate that such imports are subject to examination and treatment as necessary. The amendments specified in the Statutory Rules of 1960 modify certain regulations to streamline the process, such as removing specific animal types from examination requirements and adjusting the conditions under which wool imports must be treated. These regulations are applicable across the Commonwealth, with individual states and territories also maintaining their own quarantine requirements that must be met in conjunction with these federal regulations. The amendments do not introduce new exclusions but refine existing processes, ensuring that all imports adhere to the highest standards of biosecurity.

Key Provisions

The main operative sections of the Statutory Rules 1960, No. 85, which amend the Quarantine (Animals) Regulations, introduce changes that refine and clarify the requirements for the importation of certain animal products and the examination of animals for export. Regulation 80 is amended (paragraph 1) to require that the Chief Quarantine Officer of the relevant state or territory must be satisfied that no further treatment is necessary before allowing the importation of wool. Regulation 82 is amended (paragraph 2) by omitting a specific paragraph (ca) from sub-regulation (1), which presumably removes a previous requirement or condition that is no longer applicable. Regulation 96A is amended (paragraph 3) to broaden the scope of animals that must be examined before export, changing the previous list of specific animals to "an animal that is a bird or mammal," thus including any bird or mammal in the examination requirements. These amendments impose specific obligations on those involved in the importation and exportation of animals and animal products. Importers of wool must now ensure that the Chief Quarantine Officer of the destination state or territory has confirmed that no further treatment is necessary for the wool to be imported. This adds an additional layer of verification to ensure that the wool meets the necessary health and safety standards. For the export of animals, the requirement to examine animals is expanded to include all birds and mammals, meaning that exporters must now conduct thorough examinations of a wider range of animals before they are allowed to leave the country. These changes are intended to enhance the regulatory framework for animal health and safety. The regulations do not explicitly state any specific offences, penalties, or consequences for breaches. However, under the overarching Quarantine Act 1908-1950, failure to comply with the regulations could lead to enforcement actions, including fines or other penalties as prescribed by the Act. The precise penalties would depend on the nature and severity of the breach, as well as any relevant state or territory laws that may also apply. Non-compliance with these regulations could potentially result in the refusal of entry for animal products or animals, leading to significant disruptions and financial losses for those involved in the import and export processes.
