Overview

The Quarantine Act 1969 was enacted to amend the existing Quarantine Act 1908-1966, addressing gaps and updating provisions to better manage the risk of disease and pests entering Australia. This legislation was enacted by the Parliament of Australia to provide a more comprehensive framework for managing quarantine issues, focusing on enhancing protection against the introduction of diseases and pests through maritime, aerial, and land borders. The policy objective of this Act is to strengthen Australia's biosecurity measures, ensuring public health and agricultural safety by regulating the importation of animals, plants, and goods, and by setting out procedures and penalties for non-compliance.

Scope and Application

The Quarantine Act 1969 applies to the Commonwealth of Australia and governs the control and management of risks to human health, animal health, plant health, and the environment from infectious diseases and other contaminants. It applies to persons, entities, and industries involved in the importation and movement of goods, animals, and plants within Australia. The Act specifically addresses vessels subject to quarantine, requiring their masters to bring them to designated mooring grounds or approved places upon arrival. The Act also extends to the movement of animals, plants, and other goods across state and territory borders within Australia. The Act's application can be extended through subordinate instruments, such as regulations and proclamations. There are no stated exclusions or exemptions, but certain provisions may not apply to specific categories of vessels or goods based on their status or purpose. The Act provides penalties for various offences, including fines and imprisonment, and allows for the prosecution of offences through summary or indictment proceedings.

Key Provisions

The Quarantine Act 1969 amends the Quarantine Act 1908-1966 to introduce several key changes. The most significant changes are the introduction of new definitions, such as broadening the definition of "animal" to include dead animals and any part of an animal (section 3(a)), and redefining "goods" to include animals, plants, and any other movable property (section 3(b)). The Act also mandates that the master of a vessel subject to quarantine must bring the vessel to a designated mooring ground upon arrival at or near a port (section 26a), with a penalty of one thousand dollars for non-compliance. Additionally, the Act allows quarantine officers to approve alternative locations for the quarantine of goods, other than a quarantine station (section 46a). The Act imposes specific obligations on various parties, including requiring the notification and display of disease outbreaks on vessels (section 4), prohibiting unauthorized persons from boarding or approaching quarantined vessels (section 5), and ensuring that vessels subject to quarantine comply with mooring ground requirements (section 26a). Furthermore, it obligates individuals on or near a vessel to truthfully answer health-related questions posed by quarantine officers and submit to medical examinations when required (section 72). There are several offences and penalties stipulated within the Act. For instance, knowingly removing animals, plants, or other goods from one part of the Commonwealth to another in contravention of a proclamation carries a penalty of one thousand dollars or imprisonment for one year (section 67(1a)). Similarly, failing to truthfully answer questions or submit to a medical examination can incur a penalty of five hundred dollars or two hundred dollars, respectively (sections 72(5) and 72(6)). Additionally, the Act specifies that offences not expressly indictable and not carrying a penalty of imprisonment or carrying a penalty of imprisonment for up to one year must be prosecuted summarily (section 85(1)), while those carrying a penalty exceeding one year may be prosecuted either summarily or upon indictment (section 85(2)). The penalties for various violations have been updated, with fines ranging from two hundred dollars to two thousand dollars and imprisonment terms extending up to two years, depending on the severity of the offence (Schedule).
