Overview

The Heavy Vehicle National Law Queensland Class 3 Heavy Vehicle Maryborough Sugar Factory (Tableland Mill) Mass Exemption Notice 2015 (No. 1) was enacted to facilitate an efficient sugar cane harvest while safeguarding the road infrastructure network. This notice, issued by the National Heavy Vehicle Regulator, aims to achieve this balance through appropriate administrative procedures and compliance activities, in accordance with the Maryborough Sugar Factory Tableland Mill Self Regulation (Mass Concession) Scheme. This exemption notice allows for the operation of nominated Class 3 heavy vehicles under specific conditions, exempting them from certain mass limits prescribed in the Heavy Vehicle (Mass Dimension and Loading) National Regulation. The notice is effective from 1 October 2015 until 30 June 2016, and its provisions apply to areas and routes outlined in the aforementioned self-regulation scheme, ensuring that vehicles comply with both the notice and the scheme's requirements.

Scope and Application

The Heavy Vehicle (Maryborough Sugar Factory Tableland Mill) Mass Exemption Notice 2015 applies to eligible vehicles within Queensland, specifically those nominated Class 3 heavy vehicles registered to operate under the Maryborough Sugar Factory Self Regulation (Mass Concession) Scheme. The primary objective of this notice is to facilitate an efficient sugar cane harvest while simultaneously protecting the road infrastructure network by implementing appropriate administrative procedures and compliance activities as outlined in the Maryborough Sugar Factory Tableland Mill Self Regulation (Mass Concession) Scheme. This notice exempts these vehicles from certain prescribed mass limits specified in Schedule 1 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation, including sections 2, 4, and 5. However, the exemption is subject to conditions such as not exceeding 7.5% over the prescribed mass limits, 10% over regulation axle mass limits, and adhering to the manufacturer's ratings. Additionally, vehicles must comply with the Maryborough Sugar Factory Tableland Mill Self Regulation (Mass Concession) Scheme and carry a copy of this notice at all times. If the self-regulation scheme expires, terminates, or otherwise ceases to operate, the notice will also cease to have any effect.

Key Provisions

This notice, the Queensland Class 3 Heavy Vehicle Maryborough Sugar Factory (Tableland Mill) Mass Exemption (Notice) 2015, applies to eligible vehicles in Queensland, specifically nominated Class 3 heavy vehicles registered to operate under the Maryborough Sugar Factory Self Regulation (Mass Concession) Scheme (section 6). It provides exemptions from certain prescribed mass requirements to facilitate an efficient sugar cane harvest and protect the road infrastructure network (section 8). The notice applies to the areas and routes specified in the Maryborough Sugar Factory Tableland Mill Self Regulation (Mass Concession) Scheme (section 7). The notice imposes certain conditions on the vehicles covered by it. Firstly, vehicles must not exceed the prescribed mass limits, which are 7.5% over the prescribed mass limits and 10% over the regulation axle mass limits, but not exceeding the manufacturer's ratings (section 9). Secondly, the vehicles must comply with the provisions of the Maryborough Sugar Factory Tableland Mill Self Regulation (Mass Concession) Scheme and this notice (section 10(1)). Additionally, a copy of the notice must be carried at all times when operating under its conditions (section 10(2)). The notice does not explicitly outline specific offences, penalties, or civil/criminal consequences for breach. However, it is likely that breaches of the conditions specified in the notice, such as exceeding the mass limits or failing to comply with the Maryborough Sugar Factory Tableland Mill Self Regulation (Mass Concession) Scheme, would be considered breaches of the Heavy Vehicle (Mass Dimension and Loading) National Regulation and could result in penalties under that regulation. The Heavy Vehicle (Mass Dimension and Loading) National Regulation includes offences and penalties for exceeding prescribed mass limits, which could include fines and/or imprisonment. The exact penalties would depend on the specific circumstances of the breach.
