Overview

The Statutory Rules of 1957, numbered 9, titled "Regulations Under the Public Works Committee Act 1913-1953," were enacted to amend the Public Works Committee Regulations. These regulations were issued under the authority of the Governor-General, with advice from the Federal Executive Council, and came into operation on the first day of July, 1956. The primary purpose of these regulations was to adjust the prescribed allowances for travel expenses for the Chairman, Vice-Chairman, and members of the Committee, particularly concerning rates for travel to and from Canberra, as well as other locations, ensuring the expenses were adequately covered for their official duties. This amendment aimed to provide clarity and update the allowance rates, reflecting the evolving needs and costs associated with travel for committee members in the performance of their roles.

Scope and Application

The Public Works Committee Regulations 1957, made under the Public Works Committee Act 1913-1953, apply to the members of the Public Works Committee and its sectional committees, providing specific allowances for travel expenses incurred during the performance of their duties. The regulations set forth the allowances for travel by various means, such as by ship, railway, air, or other modes, and include provisions for necessary residence during travel. These allowances are applicable for travel to or from Canberra and for any other travel. The regulations also detail the specific rates of the allowances, with different rates for travel to or from Canberra and for other travel. The regulations are designed to ensure that members of the Public Works Committee and its sectional committees are adequately compensated for their travel expenses incurred in the course of their duties, thereby enabling them to carry out their responsibilities effectively.

Key Provisions

The Statutory Rules 1957 No. 9, enacted under the Public Works Committee Act 1913-1953, primarily amend the existing Public Works Committee Regulations to revise the prescribed allowances for travel expenses of the Chairman, Vice-Chairman, and members of the Committee. Regulation 2 outlines that the amendments to Regulation 6 shall come into effect on the first day of July 1956 (s. 1). The amendment to Regulation 6 specifies the travel allowances for the Chairman, Vice-Chairman, or any member of the Committee, with different rates for travel to or from Canberra and for any other travel (s. 2(a)). The new rates set the daily allowance at Two pounds ten shillings for travel to or from Canberra, and Four pounds four shillings for any other travel. Furthermore, the amendment alters the conditions under which a reduced rate of allowance is payable, such as when the fare includes subsistence or meals and accommodation during overnight stops (s. 2(b)). These regulations impose clear obligations on the Chairman, Vice-Chairman, and members of the Committee to adhere to the specified allowances when travelling for the purpose of performing their duties. They must ensure that any claims for travel expenses align with the prescribed rates, whether it is the standard daily allowance or the reduced rate applicable under certain conditions. Additionally, the regulations require proper documentation and substantiation for any travel expenses claimed to ensure transparency and compliance with the stipulated allowances. Failure to comply with the prescribed travel allowances outlined in these regulations can result in various consequences. Although the specific penalties or sanctions are not detailed in the legislative instrument, breaches of regulations typically result in financial penalties or corrective actions. The maximum penalties, if applicable, would depend on the severity of the breach and any additional legislative provisions that might be referenced elsewhere. Nonetheless, adherence to these allowances is crucial to avoid potential legal or administrative repercussions.
