Overview

Statutory Rules 1974 No. 67, enacted by the Public Service Board under the authority of the Public Service Act 1922-1973, addresses the need to revise salary rates for various public service positions. The Regulations were approved by the Governor-General on 27 April 1974 and were intended to bring salary rates in line with the changing roles and responsibilities within the public service. The primary objective of these amendments is to ensure fair and appropriate remuneration for public service officers, reflecting their grade and the specific duties they undertake. This legislative instrument adjusts salary rates for certain officers, including food service advisers and managers, and other public service roles, ensuring that their compensation aligns with the evolving demands of their positions.

Scope and Application

The Statutory Rules 1974 No. 67, which are regulations under the Public Service Act 1922-1973, primarily concern amendments to the Public Service (Salaries) Regulations. These regulations apply to certain officers within the public service who are classified under specific divisions and grades, particularly those related to food services and other newly introduced roles. The changes affect salary rates for various grades and positions, including the introduction of new positions like Food Service Advisers and Food Service Managers. The regulations also affect officers of the Fourth Division by adjusting their salary rates to align with those of the Third Division. These amendments are intended to standardise and update the salary structures within the public service to better reflect the responsibilities and roles of these positions. The regulations are applicable across the Commonwealth, as they are made under the authority of the Public Service Act, which has a national reach. The regulations do not explicitly state any exclusions, exemptions, or thresholds but imply that they apply to specific groups of officers as defined by their roles and grades within the public service. The application of these regulations may be further extended or restricted through subordinate instruments as necessary.

Key Provisions

The primary operative sections of the legislation (Statutory Rules 1974 No. 67) involve amendments to the Public Service (Salaries) Regulations under the Public Service Act 1922-1973. Regulation 8 and Regulation 14 of the Public Service (Salaries) Regulations are amended to adjust salary rates for certain officers within the Third and Fourth Divisions. Specifically, Regulation 8 now includes Food Service Advisers at various grades, while Regulation 14 includes Food Service Managers at various grades and Senior Food Service Advisers at certain grades. These amendments are detailed in Schedules 1 and 2 of the legislation, which adjust salary groups to reflect these changes. These amendments impose clear obligations on the Public Service Board to ensure that salaries are adjusted as specified, affecting the remuneration of specific officers within the public service. The regulations require that the appropriate salary rates be applied to the new grades and positions listed, thereby ensuring that the officers receive remuneration in line with their new classifications. The legislation does not explicitly outline offences, penalties, or consequences for non-compliance. However, given the nature of the amendments, failure to comply with these salary adjustments could potentially lead to disputes regarding remuneration, which might necessitate intervention by the Public Service Board or other relevant authorities to rectify any inconsistencies. The absence of explicit penalties in the text suggests that any enforcement would likely rely on administrative corrections rather than punitive measures.
