Overview
Statutory Rules 1977 No. 83, made under the Public Service Act 1922, were enacted to address the need for amendments to the Public Service (Salaries) Regulations. The Public Service Board, acting pursuant to the authority conferred by the Public Service Act 1922, made these regulations subject to the approval of the Administrator. The amendments primarily involve changes to salary groups within the Public Service (Salaries) Regulations, including the addition and removal of various salary groups and adjustments to existing ones. These changes reflect updates to the salary scales for specific roles within the public service. The Administrator, acting on the advice of the Federal Executive Council, subsequently approved these regulations, ensuring their implementation aligns with the objectives of the Public Service Act 1922.
Scope and Application
Statutory Rules 1977 No. 83 amends the Public Service (Salaries) Regulations under the Public Service Act 1922, applying to the public service employees of the Commonwealth of Australia. These regulations primarily revise salary groups and scales for various positions within the public service, including roles such as Assistant Director (Operations), Court Counsellor, and Electricity Control Operator. The amendments affect the remuneration structure for specified classes and grades, ensuring that salaries are updated to reflect current conditions and responsibilities. The changes are implemented through the substitution and omission of certain salary groups and the addition of new ones, as detailed in the Schedule. The Regulations extend to all Commonwealth public service employees affected by the salary group amendments, impacting their entitlements under the Public Service Act 1922. The amendments are effective as of the date of their approval by the Administrator and are binding within the Commonwealth jurisdiction.
Key Provisions
The Regulations under the Public Service Act 1922 primarily focus on amending the Public Service (Salaries) Regulations. These amendments involve restructuring and updating salary groups for various public service positions (Schedule 1, Part I, item 1). Specifically, the Regulations replace Group 13 with a new Assistant Director (Operations) salary structure and remove Group 15. Additionally, a new Group 25a is introduced for Court Counsellor positions, ranging from Class 1 to Director of Court Counselling, with corresponding salary ranges. Group 32 is omitted, and similar amendments are made to Part I of Schedule 3 (Schedule 1, Part I, item 2), introducing a new Group 83a for Electricity Control Operator positions with salary ranges from Grade 1 to Grade 3. Further amendments are detailed in Schedule 3, including the omission of several groups (Schedule 3, Part I, item 3).
The obligations imposed by these Regulations primarily concern the Public Service Board and the relevant public service entities. The Board must ensure that the amendments to salary structures are implemented across the specified public service roles. This includes updating internal records, informing affected employees of their new salary brackets, and ensuring compliance with the new pay scales. The public service entities are required to adhere to the new salary structures when determining remuneration for the positions affected by these amendments. They must also ensure that payroll systems are adjusted to reflect these changes accurately.
Breaches of these Regulations, if they occur, could result in various consequences. For instance, failure to update salary structures as required may lead to legal disputes over remuneration. While specific penalties are not outlined in these Regulations, breaches of public service laws generally could result in administrative penalties, fines, or other legal actions. Additionally, public service employees affected by non-compliance may have grounds to seek redress through internal grievance mechanisms or external legal avenues. Ensuring compliance with these amendments is therefore crucial to avoid potential legal and financial repercussions.
