Overview

The Statutory Rules 1972 No. 138, made under the Public Service Act 1922-1972, introduce amendments to the Public Service (Salaries) Regulations. Enacted by the Public Service Board, these regulations were approved by the Governor-General and aim to update and refine salary structures for various public service roles. The regulations address the need to align remuneration with evolving job roles and responsibilities within the public service sector. This legislative instrument seeks to ensure that the public service remains competitive in attracting and retaining skilled personnel by providing updated salary scales for specific roles such as anthropologists, orderly supervisors, pastoral inspectors, and hospital assistants. The enactment by the Public Service Board, in consultation with the Federal Executive Council, underscores the importance of maintaining equitable and transparent remuneration practices within the public service.

Scope and Application

The Public Service (Salaries) Regulations 1972, as amended, apply to the public service in the Commonwealth of Australia, affecting the remuneration of various public service roles. The regulations outline salary scales for different job groups and grades within the public service, ensuring consistent and equitable compensation across various roles. The scope of these regulations is limited to Commonwealth public service employees and excludes those in state or territory public services or private sector employment. The regulations are binding across the Commonwealth, as they are statutory rules made under the Public Service Act 1922-1972. The application of these regulations can be extended or refined through subordinate instruments, allowing for adjustments to salary scales and classifications as necessary. Any exclusions or exemptions are not explicitly stated in the provided excerpt, but typically, such regulations would exclude positions that are paid under separate legislative provisions or those that fall outside the defined job groups.

Key Provisions

The Statutory Rules 1972 No. 138, which amends the Public Service (Salaries) Regulations, introduces several changes to the salary groups for various public service roles. For example, under the First Schedule (1), a new group titled "Anthropologist" is added with salary brackets ranging from $10,554 to $11,254, and Group 9 is omitted (1). In the Third Schedule, Group 219 is replaced with new salary brackets for roles such as "Orderly, Grade" and "Orderly Supervisor, Grade 1" to "Grade 4" (2.1.a). Similarly, Group 225 is replaced with new salary brackets for "Pastoral Inspector" and "Senior Pastoral Inspector" (2.1.b), and Group 381 is replaced with new salary brackets for "Hospital Assistant, Grade 1" to "Grade 3" and "Hospital Assistant Supervisor, Grade 1" to "Grade 3" (2.1.c). Additionally, under Part V of the Third Schedule, item 8 is replaced with new salary brackets for "Hospital Assistant, Grade 1" based on age (2). These amendments impose clear obligations on the Public Service Board to update the salary scales for the specified roles. The Board must ensure that these changes are reflected in the relevant documentation and communicated to all affected employees. The Regulations require the Board to maintain accurate and up-to-date salary information for public service roles, ensuring that the remuneration aligns with the legislative changes. Breaches of these Regulations could lead to various civil or criminal consequences depending on the nature and severity of the non-compliance. For instance, failure to accurately update salary scales or improperly communicating these changes could result in disciplinary actions against the Board members or relevant officials. Furthermore, if the non-compliance leads to financial discrepancies or disputes among employees, it could result in legal actions, including fines or other penalties as stipulated by relevant laws governing public service administration and financial management. The exact penalties would depend on the specific breaches and the applicable laws at the time of the offence.
