Overview
The Public Service (Salaries) Regulations 1981 (Amendment) Statutory Rules 1981 No. 1101 were enacted to address the need for updating and clarifying the salary scales for certain officers within the Australian Public Service. This legislative instrument was introduced by the Public Service Board, acting under the authority conferred by the Public Service Act 1922. The regulations were subsequently approved by the Administrator of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, and dated 14 May 1981. The overarching policy objective of this amendment is to ensure that specific officers, such as Food Service Managers and Managers within the Radio Frequency Management Division, are compensated according to the appropriate salary scales, thereby maintaining fair and equitable remuneration practices within the public service.
Scope and Application
The Public Service (Salaries) Regulations, as amended, apply to certain officers within the Commonwealth public service, specifically targeting roles such as Food Service Managers and Managers within the Radio Frequency Management Division of the Department of Communications. These Regulations are made under the authority of the Public Service Act 1922 and have been approved by the Administrator, with the advice of the Federal Executive Council. They pertain to the remuneration of specified grades within the public service, thereby impacting the salaries of designated officers. The Regulations are geographically confined to the Commonwealth of Australia, and their application is limited to the categories and grades of officers specified within the Regulations. There are no explicit exclusions or exemptions outlined within the text of these Regulations, but their scope is strictly defined to the roles and grades mentioned. The application of these Regulations can be further extended or refined through subordinate instruments, as necessary, to align with evolving public service structures and salary scales.
Key Provisions
The main operative sections of this statutory instrument, the Public Service (Salaries) Regulations 1981 (Amendment), include the amendment of Regulation 14 and the insertion of a new group into Part I of Schedule 1. Regulation 14, as amended, now includes certain officers from Fourth Division to be paid at rates applicable to officers of Third Division. Specifically, it lists the "Food Service Manager, Grade 5" alongside "Manager, Grade 1," "Manager, Grade 2," and "Manager, Grade 3" (Regulation 14). Furthermore, a new group, "Group 56a," has been inserted into Part I of Schedule 1, detailing the salary ranges for the "Manager, Grade 1," "Manager, Grade 2," and "Manager, Grade 3" within the Department of Communications—Radio Frequency Management Division (Schedule 1—Part I).
These amendments impose obligations and requirements on the Public Service Board to ensure that the specified officers are compensated appropriately according to the new salary rates. This includes updating internal records, payroll systems, and possibly revising job descriptions or classifications to reflect the changes. Furthermore, the Department of Communications—Radio Frequency Management Division must adhere to the newly defined salary scales for its managerial positions, ensuring compliance with these updated remuneration standards.
Failure to comply with the provisions of these amended regulations may result in legal and administrative consequences. While specific offences, penalties, or consequences are not detailed within this statutory instrument, breaches of public service salary regulations could potentially lead to legal actions, financial penalties, or other corrective measures as prescribed by the Public Service Act 1922 and associated legislation. The exact penalties would depend on the nature and severity of the breach, as well as any additional regulations or directives issued under the authority of the Act.
