Overview
The Public Service (Salaries) Regulations 1981 (Amendment) Statutory Rules 1981 No. 194 were enacted to address the need for updated salary classifications within the Australian public service. This legislative instrument was approved by the Governor-General, Zelman Cowan, and implemented by the Public Service Board under the authority of the Public Service Act 1922. The amendments introduced new salary groups and rates for specific roles, ensuring that the remuneration of public servants is reflective of their responsibilities and the changing economic conditions. The intent of these regulations was to maintain fair and competitive compensation within the public sector, thereby supporting the efficient functioning of government services and the retention of skilled personnel.
Scope and Application
The Public Service (Salaries) Regulations 1981, as amended, apply to the remuneration of public service officers within the Commonwealth of Australia, encompassing a wide range of positions across various departments and agencies. These regulations are particularly pertinent to officers within the Department of Health and those involved in recording equipment operations, as evidenced by the amendments detailing specific salary scales for positions such as the Director of Biostatistics at the Commonwealth Institute of Health and Recording Equipment Officers at different grades. The regulations are geographically applicable across the Commonwealth, extending to all federal public service roles. Notably, these amendments are made under the authority of the Public Service Act 1922 and have been approved by the Governor-General, thereby establishing their legal standing and applicability. The regulations do not explicitly state exclusions or exemptions but rather provide specific salary details for certain roles, which implies that these are the positions directly affected by the amendments. Subordinate instruments or further legislative amendments could potentially extend or modify the scope of these regulations, although the current text does not provide specific details on such possibilities.
Key Provisions
The main operative sections of the Public Service (Salaries) Regulations (Amendment) are found in Schedule 1 and Schedule 3 of the Statutory Rules 1981 No. 1941. Schedule 1, Part I introduces a new salary group for a Director (Biostatistics) at the Commonwealth Institute of Health, Department of Health, with a salary range of $35,049 (item 1). Schedule 3, Part I revises existing salary groups by adding a new Group 265 for Recording Equipment Officers, with three grades offering salaries of $13,082, $13,317, and $13,549 for Grade 1, and $14,116 for Grade 2 (item 2). Furthermore, it removes Group 291 from the salary schedule (item 2(b)).
These Regulations impose specific obligations on the Public Service Board to ensure that the salary structures for public service employees are updated in accordance with legislative requirements. The Board must ensure that new positions, such as the Director (Biostatistics), are appropriately classified and compensated, and that existing roles are accurately represented in the salary scales. The Board also has the duty to notify and publish these amendments to ensure transparency and compliance within the public service.
Breach of these Regulations may not explicitly outline criminal or civil penalties within the text itself. However, non-compliance with public service salary regulations could potentially lead to administrative consequences, such as disciplinary action against public servants or the Public Service Board. Additionally, failure to adhere to these salary schedules may result in legal disputes regarding the correct remuneration for public service roles, which could necessitate judicial intervention to resolve discrepancies.
