Overview

The Statutory Rules 1973 No. 216, made under the authority of the Public Service Act 1922-1973, address the need for updating the salary structures for officers within the Second Division of the Public Service. This regulation was enacted by the Public Service Board and subsequently approved by the Governor-General, ensuring that the legislative changes align with the overall policy objectives of the Public Service Act. The intent behind these amendments is to provide a revised framework for the remuneration of public servants, reflecting contemporary economic conditions and the need for fair compensation within the public sector. By establishing a new salary scale, the regulation aims to maintain the efficiency and integrity of the public service, ensuring that officers are appropriately compensated for their roles and responsibilities.

Scope and Application

The Statutory Rules 1973 No. 216, made under the Public Service Act 1922-1973, amends the Public Service (Salaries) Regulations, specifically altering the rates of salaries payable to officers in the Second Division. This legislative instrument applies to officers within the Second Division of the Australian Public Service, affecting their remuneration and employment terms. The regulation is part of the broader Commonwealth framework, thus applying across all states and territories in Australia. The regulation does not explicitly state exclusions or exemptions, but by its nature, it is limited to the officers in the specified division, excluding other ranks and categories of public servants. This amendment extends the application of the original Public Service (Salaries) Regulations by updating the salary rates as per the new table provided in the statutory rules, ensuring alignment with the current economic conditions and employment standards.

Key Provisions

The primary operative sections of these regulations, as set forth under the Public Service Act 1922-1973, involve the amendment of the Public Service (Salaries) Regulations (Reg. 5). Specifically, they address the salaries payable to officers of the Second Division, providing a detailed table that replaces the previous one. This table lists various levels of office and their corresponding salary rates in Australian dollars. For instance, the salary for Level 1 is set at $17,300, rising incrementally to $26,225 for Level 6. These regulations impose specific obligations on the Public Service Board, which must ensure the updated salary rates are correctly applied to officers within the Second Division. The Board is also responsible for communicating these changes to relevant personnel and ensuring that the new salary structure is effectively implemented across the designated offices. This requirement ensures that all officers are compensated in accordance with the new rates as outlined in the amended regulations. In the event of non-compliance with these salary regulations, there may be significant consequences. While the specific legislation does not detail explicit offences or penalties, breaches of public service regulations generally can lead to disciplinary action against officers or officials involved. This can include formal reprimands, fines, or other administrative penalties. The severity of these consequences would depend on the nature and extent of the breach, as well as any mitigating or aggravating factors present in the particular case. Overall, these regulations serve to formalise and clarify the salary structure for Second Division officers, ensuring transparency and consistency in public service remuneration. The Public Service Board’s role in enforcing these regulations is crucial to maintaining the integrity of the public service pay system. Adhering to these provisions helps to uphold the statutory framework designed to govern the public service in Australia.
