Overview

The Statutory Rules 1972 No. 0004 under the Public Service Act 1922-1968 was enacted in 1972 to address specific amendments within the Public Service (Salaries) Regulations. The Public Service Board, acting on the authority conferred by the Public Service Act, made these regulations, which were subject to the approval of the Governor-General. The policy objective, as implied by the amendment, is to establish a structured salary progression for the Foreign Affairs Trainee Group, ensuring clarity and consistency in remuneration for this category within the public service. This legislative instrument was approved by the Governor-General and published in the Commonwealth Gazette, reflecting the formal legislative process and the importance of updating public service regulations to meet contemporary needs.

Scope and Application

This regulation applies to the Commonwealth public service and specifically amends the Public Service (Salaries) Regulations, impacting the remuneration of individuals employed within the Public Service. The regulation establishes a new salary group, Group 48A, applicable to Foreign Affairs Trainees. This adjustment in salary brackets is intended to reflect the specific needs and responsibilities associated with the training and development of these trainees within the Foreign Affairs sector. The amendment is made under the authority conferred by the Public Service Act 1922-1968 and extends to the entire Commonwealth, thereby impacting all federal public service employees. The regulation does not exclude any specific individuals or entities, but rather applies to all Foreign Affairs Trainees within the public service. The regulation is part of a broader framework that allows for further adjustments and specifications through subordinate instruments, ensuring that the public service's salary structures can be responsive to changing needs and economic conditions.

Key Provisions

The main operative sections of this statutory rule are found within the First Schedule, specifically Part I, which amends the Public Service (Salaries) Regulations. This amendment introduces a new salary group, Group 48A, for Foreign Affairs Trainees, as indicated in section 1 of the First Schedule. This new group establishes a salary range that begins at $4,480 and increases to $6,712, with specific intervals between each salary point. The obligations and requirements imposed by this regulation are primarily related to the payment of salaries. Public service entities must adhere to the newly established salary structure for Foreign Affairs Trainees, ensuring that remuneration falls within the specified range. This amendment reflects the Board's intention to formalise the compensation for this specific role within the public service. Entities must ensure compliance with these new salary provisions when making payments to Foreign Affairs Trainees, as outlined in section 1 of the First Schedule. The statutory rule does not explicitly state any offences, penalties, or civil/criminal consequences for non-compliance with the salary provisions outlined in the regulation. However, failure to adhere to the specified salary structure could potentially lead to legal challenges from employees regarding their remuneration. Public service entities are expected to implement the new salary group accurately and ensure that Foreign Affairs Trainees are compensated as per the stipulated ranges. It is implied that adherence to these provisions is crucial to maintain fair and lawful practices within the public service.
