Overview

The Statutory Rules 1973 No. 33, enacted under the Public Service Act 1922-1972, introduces a regulation aimed at addressing the need for adjustments to the salary rates of public service officers who are pursuing or have completed higher education qualifications. The regulation, made by the Public Service Board and approved by the Governor-General, amends the Public Service (Salaries) Regulations to better align the remuneration of officers with their educational achievements. The policy objective is to provide financial incentives to officers who engage in advanced studies, thereby encouraging professional development and enhancing the overall qualifications within the public service. This amendment aims to ensure that officers who undertake higher education are adequately compensated, which in turn supports the efficiency and effectiveness of the public service.

Scope and Application

This statutory regulation under the Public Service Act 1922-1972 pertains to the Public Service (Salaries) Regulations and specifically modifies the second schedule concerning allowances for officers in the public service who hold or are eligible to hold degrees or diplomas from prescribed institutions. The regulation applies to officers within the Third Division of the public service who are either admitted or eligible to be admitted to a degree or diploma of a prescribed institution, such as Australian universities or colleges of advanced education, or equivalent overseas qualifications. The regulation sets out a tiered structure for allowances based on the type and level of degree or diploma held, with higher qualifications attracting larger allowances. These allowances are intended to compensate officers whose salaries are below the rates appropriate for their qualifications. The regulation also outlines specific conditions under which the allowances apply, including requirements for the duration of study for certain degrees. The scope of this regulation is national, as it extends across the Commonwealth of Australia and is subject to the Public Service Act 1922-1972.

Key Provisions

The main operative sections of this regulation (Sections 2 to 6) detail the allowances for officers in the Third Division who are admitted to or eligible for admission to degrees from prescribed institutions. Section 2 clarifies the definitions of terms such as 'college of advanced education' and 'degree of a prescribed institution'. Section 3 provides that an officer whose salary is less than the appropriate rate in relation to their degree should be paid an allowance for the difference. Section 4 specifies the appropriate rates for officers based on the degree they hold or are eligible to hold, with rates ranging from $5,850 for degrees higher than a Bachelor's degree to $4,850 for Bachelor's degrees with a three-year course of study. Section 5 outlines the appropriate rates for officers who hold or are eligible to hold additional degrees or diplomas, provided that the courses aggregate to at least four years. Section 6 explains that the rate at which salary is payable to an officer includes any applicable allowances under regulation 87 of the Public Service Regulations. The regulation imposes specific obligations on the Public Service Board and the officers it governs. The Public Service Board must ensure that the regulations are implemented correctly and that officers are paid the appropriate rates based on their qualifications. Officers, on the other hand, must meet the eligibility criteria for the degrees or diplomas to qualify for the allowances. This includes being admitted to or eligible to be admitted to a degree or diploma from a prescribed institution and ensuring that the courses aggregate to at least four years where applicable. Breaches of this regulation may not explicitly outline specific offences, penalties, or civil/criminal consequences. However, failure to comply with the regulation could potentially lead to disputes over salary payments, which may need to be resolved through administrative or judicial processes. The regulation does not specify maximum penalties, but any breaches could result in legal action to enforce the correct payment of allowances or to rectify any underpayments. The consequences for non-compliance would likely depend on the specific circumstances of each case and the outcomes of any legal proceedings.
