Overview

Statutory Rules 1974 No. 134, under the Public Service Act 1922-1973, was introduced to amend the Public Service (Salaries) Regulations, addressing the need to update salary rates for various public service positions. The Public Service Board, acting on the authority conferred by the Public Service Act, made these Regulations, which were subsequently approved by the Governor-General. The primary objective of these amendments was to reflect the changing economic conditions and to ensure that the remuneration of public service officers remains fair and competitive. By updating the salary tables and categorising certain officers to be paid at rates applicable to higher divisions, the Regulations aimed to maintain the efficiency and effectiveness of the public service while recognising the roles and responsibilities of the officers involved.

Scope and Application

The Statutory Rules 1974 No. 134, which are regulations made under the Public Service Act 1922-1973, pertain to the remuneration of specific officers within the Australian Public Service. These regulations apply to the officers listed in the amended regulations, such as those in the Airways Telecommunications, Preventive, and Transport sectors, as well as other designated roles, thereby ensuring they are compensated according to the newly specified rates. The regulations are geographically applicable across Australia, as they are enacted under a Commonwealth statute. There are no stated exclusions or exemptions in these regulations; however, they are subject to amendment through subordinate instruments, reflecting changes in public service roles and remuneration structures over time. The scope of these regulations is limited to adjusting salary levels for certain positions within the public service, and they do not extend to other areas such as employment conditions or benefits beyond salary adjustments.

Key Provisions

The Regulations under the Public Service Act 1922-1973 primarily serve to amend the Public Service (Salaries) Regulations, specifically addressing the salaries of certain officers within the public service. Regulation 5 updates the salary rates for officers of the Second Division, as detailed in a new table provided (Regulation 1). Additionally, Regulation 8 expands the categories of officers in the Third Division who will be compensated at the rates applicable to the Fourth Division, including several new positions such as Assistant Chief Preventive Officer, Chief Investigator, and Senior Preventive Officer (Regulation 2). These amendments ensure that specific roles within the public service receive appropriate remuneration based on their respective levels of responsibility and expertise. The Regulations impose specific obligations on the Public Service Board to ensure that the salary rates outlined are accurately applied to the relevant positions. This includes updating the records and systems to reflect the new salary structures, thereby ensuring that affected officers are compensated in accordance with the stipulated rates. Furthermore, the Board is responsible for disseminating this information to all relevant departments and officers to ensure compliance with the updated salary regulations. Failure to comply with the new salary provisions could result in legal and administrative consequences. While the Regulations themselves do not explicitly detail specific penalties for non-compliance, breaches of public service salary regulations could potentially lead to disciplinary action under the broader Public Service Act 1922-1973. Such actions may include formal warnings, fines, or other corrective measures, depending on the severity and intent of the non-compliance. Additionally, officers who do not receive the correct remuneration may have grounds to pursue legal action for underpayment, which could further result in monetary compensation and interest for the unpaid wages.
