Overview

The Statutory Rules 1973 No. 60, titled "Regulations under the Public Service Act 1922-1972," were enacted to amend the Public Service (Salaries) Regulations, addressing the need for updated salary scales and classifications within the Australian Public Service. The Public Service Board, exercising its authority under the Public Service Act, made these regulations, which were subsequently approved by the Governor-General. The policy objective behind these amendments was to ensure that salary structures within the public service remain competitive and reflective of the changing roles and responsibilities of various positions, thereby maintaining an efficient and motivated public service workforce. This legislative instrument aims to align the remuneration of public service employees with market standards and organisational needs.

Scope and Application

The Regulations under the Public Service Act 1922-1972, made by the Public Service Board and approved by the Governor-General, apply to various public service roles across different states and territories within the Commonwealth of Australia. These Regulations primarily focus on amending salary structures for specific groups of public service officers. The changes involve reclassification and adjustment of salary scales for various positions, including Actuary, Deputy Commissioner of Police, Fish Exports Standards Officer, Veterinary Officer, Custodian (Buildings), Parking Inspector, Printing Production Supervisor, Stenographer (Reporting), and Telecommunications Assistant. Each state and territory has its own set of salary scales adjusted in these Regulations, ensuring consistency and fairness in remuneration across the public service. The application of these Regulations is national, affecting public servants employed in federal roles across all states and territories. The Regulations do not explicitly state any exclusions or thresholds but are intended to align the remuneration of public servants with their roles and responsibilities, ensuring that compensation is fair and reflective of the duties involved.

Key Provisions

The Regulations under the Public Service Act 1922-1972 primarily involve amendments to the Public Service (Salaries) Regulations, which are detailed in Schedule 1 and Schedule 2. The changes are focused on adjusting salary scales for various public service positions. For instance, Schedule 1 modifies the salary brackets for positions such as Actuary (Regulation 1), Deputy Commissioner of Police (Regulation 3), and Fish Exports Standards Officers (Regulation 4). Additionally, it revises the salary scales for Veterinary Officers (Regulation 4). Schedule 2, on the other hand, makes changes to roles like Custodian (Buildings) (Regulation 1), Parking Inspector (Regulation 3), and Printing Production Supervisor (Regulation 4). It also updates the salary scales for positions such as Stenographer (Reporting) (Regulation 5) and Telecommunications Assistant-in-training (Regulation 6). These amendments ensure that the remuneration for public service roles is kept current and reflective of the responsibilities and qualifications required for each position. These Regulations impose specific obligations on public service employees and their employers. They ensure that employees within the specified roles are compensated according to the newly established salary brackets. Employers, including departments and agencies under the Commonwealth, are required to adhere to these updated salary scales when determining compensation for their staff. Additionally, these Regulations mandate that any discrepancies in remuneration, arising from the amendments, are to be rectified in accordance with the new schedules. The changes are designed to maintain equity and fairness in public service remuneration, ensuring that all employees are compensated appropriately for their roles. The Regulations do not explicitly mention any specific offences or penalties for non-compliance. However, non-adherence to these salary provisions could potentially lead to disputes regarding remuneration. Employees who believe they are not being paid according to the updated scales may seek recourse through internal dispute resolution mechanisms or via the Fair Work Commission. The primary consequence of non-compliance would be financial, as employees may not receive the correct salary for their positions, leading to dissatisfaction and potential legal action. It is important for employers to ensure they are complying with these Regulations to avoid such issues.
