Overview

Statutory Rules 1975 No. 87, enacted under the Public Service Act 1922-1974, aims to amend the Public Service (Salaries) Regulations. The Public Service Board, acting on the authority of the Public Service Act 1922-1974, established these regulations to refine the salary scales and allowances for various public service officers, thereby ensuring fair remuneration practices across different divisions and grades. The regulations were approved by the Administrator of the Government of Australia, acting on the advice of the Executive Council, and subsequently ratified by the Governor-General. The policy objective of these amendments is to streamline and update the salary structures to reflect current market conditions and maintain equitable pay across different roles within the public service. The regulations encompass several amendments to existing salary scales, including adjustments to the rates for specific officer positions, the introduction of new allowances for certain officers, and the consolidation of salary scales across different divisions. These changes are designed to ensure that public service officers receive fair and competitive compensation, reflecting their roles and responsibilities. The enacting body, the Public Service Board, acted within its legislative mandate to implement these changes, ensuring the regulations align with the overarching objectives of the Public Service Act 1922-1974.

Scope and Application

The Public Service (Salaries) Regulations 1975, made under the Public Service Act 1922-1974, apply to certain officers within the Commonwealth public service, specifically those in the Third and Fourth Divisions. These regulations detail amendments to salary rates and allowances for various positions, including the removal and substitution of certain job titles with new salary scales. The regulations affect a range of roles such as illustrators, graphic design assistants, technical assistants, and others, by adjusting their classification and corresponding pay rates. The geographic reach of these regulations is national, applying across all jurisdictions within Australia, as they pertain to Commonwealth public service employees. The regulations also provide for the approval of these changes by the Governor-General and the Administrator, ensuring alignment with overarching public service policies. Any exclusions or exemptions from these salary adjustments are specifically outlined within the regulations, detailing which positions or roles are not subject to the changes. The regulations may be further extended or restricted through subordinate instruments, which would be detailed in additional legislative or administrative notices.

Key Provisions

The regulations under the Public Service Act 1922-1974, specifically Statutory Rules 1975 No. 87, include amendments to the Public Service (Salaries) Regulations. Regulation 8 is amended by removing the titles of certain officers such as Chief Illustrator, various grades of Illustrating Assistant, Plan Records Assistant, and Senior Illustrator from the list of those eligible for specific salary rates (Regulation 1). Additionally, Regulation 13 is amended to specify that Graphic Design Assistant, Grade 1, and Technical Assistant, Grade 1 are now eligible for allowances, replacing previous categories (Regulation 2). Regulation 14 is repealed and replaced with a new regulation that aligns the salary rates of certain Fourth Division officers with those of Third Division officers for specific roles, including Food Service Manager, Instructor, Phonogram Supervisor, Postmaster, Radiograph-in-training, Remedial Physical Training Instructor, and various Supervisory and Telegraph positions (Regulation 3). These regulations impose specific obligations on the Public Service Board to ensure that the amendments to salary rates and allowances are correctly applied to the designated positions. The Board must ensure that officers in the affected categories receive the appropriate salary rates as per the updated schedules and that any previous entitlements or allowances are adjusted accordingly. The obligations also include maintaining accurate records and ensuring compliance with the new regulations across all relevant divisions and roles. Failure to comply with these regulations could result in legal consequences for both the officers and the Public Service Board. While the specific penalties for non-compliance are not detailed in the provided text, breaches of public service regulations typically result in disciplinary actions, potential salary adjustments, or other administrative penalties. In severe cases, non-compliance could lead to legal action against the Board or affected officers, resulting in fines or other sanctions as prescribed by the relevant legislation.
