Overview

The Public Service (Salaries) Regulations 1972 were enacted to amend the existing public service salary structures in line with the Public Service Act 1922-1972. The regulations were made by the Public Service Board, acting under the authority of the Act, and were approved by the Governor-General as part of statutory rules notified in the Commonwealth Gazette in 1972. The primary objective of these regulations is to update and refine the salary classifications and allowances for various public service roles, ensuring they reflect the current demands and responsibilities of each position. By updating these classifications, the regulations aim to maintain fairness and competitiveness in public sector remuneration, which is crucial for attracting and retaining skilled professionals in the public service.

Scope and Application

The Public Service (Salaries) Regulations 1972, made under the Public Service Act 1922-1972, apply to Commonwealth public service officers, specifically those in designated salary groups and classifications within the Australian public service. These Regulations cover a wide range of positions, including roles such as Specialist Advisers, Health Inspectors, Quarantine Assistants, and Safety Instructors, setting out their respective salary scales. The application of these Regulations is national in scope, affecting all Commonwealth public service officers across Australia. Notably, these Regulations do not specify exclusions or exemptions, implying that all covered positions are subject to the outlined salary structures and allowances. The Regulations can be further extended or modified through subordinate instruments, as evidenced by the various amendments noted in the schedules, which adjust salary scales and introduce new positions. These amendments ensure that the salary structures remain current and reflective of the changing needs of the public service.

Key Provisions

The Regulations under the Public Service Act 1922-1972, specifically the Public Service (Salaries) Regulations, outline amendments to salary groups for various positions within the public service. For instance, Regulation 2 amends Part I of the Third Schedule by replacing Group 130 with new salary brackets for Health Inspectors and omitting certain groups like 149, 150, and 151. It also introduces new groups such as Keyboard Instructors and Manual Arts Instructors, with specific salary ranges for each grade. Moreover, it replaces Group 250 with a new set of salary brackets for Quarantine Assistants and introduces new groups for Quarantine Inspectors. Regulation 3 modifies the Fourth Schedule by omitting certain items and introducing new ones, including an allowance for Quarantine Assistants who hold specific qualifications. These Regulations impose several obligations on the entities they govern. They mandate that salary brackets and allowances for specific roles within the public service be updated as per the new amendments. This includes the reclassification of existing roles and the introduction of new positions with defined salary structures. For example, Health Inspectors, Keyboard Instructors, and Quarantine Assistants must now adhere to the new salary brackets specified in the Regulations. Additionally, entities must ensure that any employees in these roles receive the correct salary or allowances as per the updated criteria. Breaching these Regulations can result in serious consequences. Although the specific offences and penalties are not detailed within these Regulations, breaches of public service regulations generally can lead to disciplinary actions, financial penalties, or even legal action. The severity of the consequences would depend on the nature and extent of the breach, but the potential for significant repercussions underscores the importance of compliance. In general, non-compliance with public service regulations can lead to investigations by relevant authorities, which may result in formal disciplinary measures against the entities or individuals involved.
