Overview

The Statutory Rules 1974 No. 24, enacted under the Public Service Act 1922-1973, was made by the Public Service Board and approved by the Governor-General on 26 February 1974. This regulation aimed to amend the Public Service (Salaries) Regulations, addressing the need for updating salary structures for various public service positions. The regulation was enacted to ensure that salary scales were current and reflective of the roles and responsibilities within the public service. The Public Service Board, acting on the authority conferred by the Public Service Act 1922-1973, made these amendments subject to the approval of the Governor-General, who subsequently approved the regulation following advice from the Executive Council. The policy objective was to provide a fair and competitive remuneration package for public service employees, thereby maintaining their motivation and efficiency within the public sector.

Scope and Application

The Statutory Rules 1974 No. 24 under the Public Service Act 1922-1973 pertains to amendments of the Public Service (Salaries) Regulations, impacting several positions within various governmental departments and services. The regulation specifically targets salary adjustments for certain groups, including the Director of Publications—National Library of Australia, the Director (Publishing)—Australian Government Publishing Service, the Government Printer, and several other roles such as the Assistant Battery Manager, Battery Manager, and Senior Battery Manager, among others. This regulation applies to all employees in these specified positions across different states and territories of Australia. The amendments are set out in Schedule 1 and Schedule 2, which detail the salary adjustments for the respective groups. The regulation extends its application through subordinate instruments by making specific amendments to existing salary groups as outlined in the schedules. The regulation does not explicitly state any exclusions or exemptions but is limited to the specified salary adjustments within the provided schedules.

Key Provisions

The Statutory Rules 1974 No. 24, under the Public Service Act 1922-1973, amends the Public Service (Salaries) Regulations. This regulation, made by the Public Service Board and approved by the Governor-General, modifies the salary schedules for certain positions within the public service. Specifically, Part I of the First Schedule, which deals with salary groups for various roles, has been updated (Regulation 1). For instance, the Director of Publications at the National Library of Australia is now classified under Group 38 with a salary of $14,800, while the Director (Publishing) at the Australian Government Publishing Service is placed in Group 40 with a salary of $15,950. Additionally, the Government Printer's salary has been adjusted to $15,100 under Group 61. These amendments impose clear obligations on the relevant government departments and agencies to ensure that the new salary scales are correctly applied to the specified positions. It is imperative that these changes are reflected in the payroll systems and that the appropriate remuneration is disbursed in accordance with the updated salary groups. This requirement extends to updating any documentation, internal records, and possibly notifying affected employees of the changes. Failure to comply with these amended salary regulations could result in administrative or legal repercussions. The precise nature of these consequences, however, is not explicitly detailed within the legislative instrument itself. Typically, such non-compliance might lead to financial discrepancies, potential legal disputes over correct remuneration, or other administrative penalties as stipulated by the broader public service laws and regulations. The exact penalties would depend on the specific circumstances and the interpretation of related legislation.
