Overview
Statutory Rules 1975 No. 53, the Regulations under the Public Service Act 1922-1974, were enacted by the Public Service Board, with subsequent approval by the Governor-General. These regulations were introduced to make amendments to the Public Service (Salaries) Regulations, addressing gaps and updating the salary scales for various positions within the public service. The policy objective behind these amendments was to ensure that the remuneration for public service officers remains competitive and reflective of the roles they perform, thus maintaining the efficiency and effectiveness of the public sector workforce.
The amendments, as outlined in the regulations, involved the insertion and omission of certain salary scales for different positions, including graphic design assistants and fire safety officers, among others. The regulations also introduced new salary groups and omitted outdated ones, reflecting changes in job responsibilities and the evolving nature of the public service. By updating these salary regulations, the legislation aimed to support the ongoing professional development and retention of skilled public service officers, ultimately contributing to the efficient delivery of public services.
Scope and Application
The Public Service (Salaries) Regulations 1975, made under the authority of the Public Service Act 1922-1974, apply to officers of the Commonwealth Public Service, specifically those within the Australian Government who are employed under the Public Service Act. These regulations primarily address the remuneration and classification of various roles, including the addition of new classifications such as Graphic Design Assistant and Graphic Designer, as well as adjustments to existing roles like the Australian Government Dairy Expert. The regulations provide specific salary scales for different grades and years of service, ensuring that remuneration is appropriately structured and aligned with the duties and responsibilities of each role. This legislation has a national reach as it applies across all states and territories of Australia, governing the pay scales and conditions for Commonwealth employees. The regulations also outline amendments to existing salary structures and the insertion of new classifications, which are detailed in the schedules of the regulations. Any exclusions or exemptions are not explicitly stated in the provided text, but the detailed amendments suggest that the regulations are intended to comprehensively update and refine the salary structures for specified roles within the Commonwealth Public Service.
Key Provisions
The main operative sections of these Regulations amend the Public Service (Salaries) Regulations under the Public Service Act 1922-1974. Specifically, Regulation 1 modifies the salary rates for certain officers within the Third Division by aligning them with the rates applicable to Officers of the Fourth Division. This includes Graphic Design Assistants and Graphic Designers at various grades. Regulation 2 introduces a new Group 15a for Australian Government Dairy Experts, specifying their salary rates, and removes Group 26 from the regulations. Regulation 3 amends Part I of Schedule 3 by inserting new salary groups for Graphic Design Assistants at different age brackets, and Regulation 4 amends Part III of Schedule 3 to include Graphic Design Assistants in the salary scale. Additionally, Regulation 3 further amends Part I of Schedule 3 by adding new groups for Fire Safety Officers, Gardeners, and Mechanics (Civil Aviation), and modifies existing groups within the same schedule.
The Regulations impose specific obligations and requirements on the parties they govern. These obligations include the duty to pay officers within the Third Division at the newly specified rates aligned with Officers of the Fourth Division. For instance, Graphic Design Assistants and Graphic Designers at various grades must now be remunerated according to the new scales. The creation of new salary groups for roles such as Australian Government Dairy Experts, Fire Safety Officers, Gardeners, and Mechanics (Civil Aviation) necessitates that these officers be compensated according to the newly defined rates. The amendments require adherence to the new salary brackets and groups, ensuring that all relevant officers receive appropriate remuneration as per the updated regulations.
Failure to comply with these Regulations may result in various civil and criminal consequences. Although the specific offences and penalties are not detailed within the text of the Regulations themselves, breaches of public service regulations generally can lead to disciplinary actions, fines, and potentially criminal charges, depending on the severity and intent behind the non-compliance. The maximum penalties for such breaches could vary, but they typically include substantial fines and, in cases of willful misconduct, imprisonment. It is important for the parties governed by these Regulations to ensure full compliance to avoid any legal repercussions.
