Overview
Statutory Rules 1976 No. 43, the Regulations under the Public Service Act 1922-1975, were enacted to provide specific amendments to the Public Service (Salaries) Regulations. This legislative instrument addresses the need to adjust salary rates for certain technical teaching positions within the public service. The Public Service Board, acting under the authority conferred by the Public Service Act, made these regulations subject to the Administrator’s approval. The policy objective is to ensure that the salaries of technical teaching staff are aligned with the appropriate pay scales, reflecting their roles and responsibilities within the public service framework. The Administrator, acting with the advice of the Executive Council, approved these regulations on 30 January 1976, ensuring that the necessary adjustments to the salary scales for technical teaching positions are implemented effectively.
Scope and Application
The Statutory Rules 1976 No. 43, made under the Public Service Act 1922-1975, outline amendments to the Public Service (Salaries) Regulations. These regulations apply to certain officers within the Commonwealth public service, specifically targeting roles such as Head Teacher (Technical), Principal Head Teacher (Technical), and Senior Head Teacher (Technical), by aligning their pay rates with those applicable to officers of the Fourth Division. This adjustment is geographically bound to the Commonwealth jurisdiction, impacting federal public service employees. The regulations were approved by the Administrator and are effective across the national scope of the Australian public service. The changes are limited to salary adjustments and do not extend to other aspects of employment conditions or entitlements. Any further application or interpretation of these regulations may be detailed in subordinate instruments or guidelines issued by the Public Service Board.
Key Provisions
The Regulations under the Public Service Act 1922-1975, specifically Statutory Rules 1976 No. 43, primarily amend the Public Service (Salaries) Regulations by adjusting the salary rates for certain technical teaching positions within the public service. Regulation 8 has been modified to include new roles such as Head Teacher (Technical), Principal Head Teacher (Technical), and Senior Head Teacher (Technical) alongside existing positions like Graphic Designer, Grade 5, and Preventive Officer-in-training. These new roles are now subject to salary rates that previously applied only to officers of the Fourth Division.
These amendments establish a structured remuneration framework for technical teaching staff, ensuring they are compensated according to a clearly defined scale. By including these technical teaching positions in the salary schedule, the Regulations formalise their integration into the public service's salary structure, providing clarity and consistency in compensation for these roles.
The Regulations impose clear obligations on the public service to adhere to the new salary rates for the specified technical teaching positions. Public service entities must ensure that these positions are compensated according to the newly defined salary scales, which are detailed in Schedule 3—Part I of the Public Service (Salaries) Regulations. This includes updating internal payroll systems and ensuring that all relevant documentation accurately reflects the new salary structures.
Failure to comply with the amended salary provisions could result in administrative and legal repercussions. While the specific penalties for non-compliance are not detailed within the Regulations themselves, breaches of public service salary regulations could lead to disciplinary actions against public service officials. Such actions could include formal warnings, fines, or more severe administrative penalties, depending on the severity and frequency of the non-compliance. These consequences underscore the importance of adhering to the specified salary scales to maintain the integrity and fairness of the public service remuneration system.
