PUBLIC SERVICE (SALARIES) REGULATIONS

Part I.—Preliminary.

Citation.

1. These Regulations may be cited as the Public Service (Salaries) Regulations.

Repeal.

2. The Public Service (Salaries) Regulations, comprising the following Statutory Rules, are repealed:—

Interpretation.

4.—(1.) In these Regulations, unless the contrary intention appears, “rate” means rate per annum.

(2.) In these Regulations, a reference to salary or an allowance at the rate of a specified sum in dollars shall be read as a reference to salary or the allowance at the rate of that specified sum per annum.

Part II—Salaries and Allowances Payable to Officers of the Second Third or Fourth Division.

Salaries payable to officers of Second Division.

5. For the purposes of sub-section (2.) of section 30 of the Act, the rate at which salary is payable to an officer who occupies an office in the Second Division is the rate specified in the second column of the following table that is appropriate to that office having regard to its classification:—

Salaries payable to officers of Third Division—general scales.

6.—(1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies an office in the Third Division specified or described in the first column of Part I. of the First Schedule to these Regulations is, subject to sub-regulation (2.) of the next succeeding regulation, the rate or scale of rates, specified in the second column of that Schedule in relation to that office.

(2.) For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates in accordance with which salary is payable to an officer who occupies an office in the Third Division to which there is allotted by its classification the minimum and maximum rates specified, respectively, in the second and third columns of Part II. of the First Schedule to these Regulations is, subject to sub-regulations (1.) and (2.) of the next succeeding regulation, the scale of rates specified in the fourth column of that Part in relation to those minimum and maximum rates.

(3.) For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates in accordance with which salary is payable to an officer who occupies an office in the Third Division specified in the first column of Part III. of the First Schedule to these Regulations is, subject to sub-regulation (1.) of the next succeeding regulation, the scale of rates specified in the second column of that Part in relation to that office.

(4.) For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates in accordance with which salary is payable to an officer who occupies an office in the Third Division specified in the first column of Part IV. of the First Schedule to these Regulations is the scale of rates specified in the second column of that Part in relation to that office.

Minimum salaries payable to officers of Third Division according to age.

7.—(1.) Where an officer—

(a) was not an employee immediately before he was appointed an officer;

(b) occupies, immediately after being appointed an officer, an office in the Third Division referred to in sub-regulation (2.) or (3.) of the last preceding regulation; and

the minimum rate at which salary is payable to the officer while be continues to occupy the office is the rate specified in the second column of that table in relation to the age of the officer in the first column of that table

(2.) For the purposes of sub-section (2.) of section 30 of the Act, the rate at which salary is payable to an officer who—

(a) occupies an office in the Third Division specified or described in an item in Part V. of the First Schedule to these Regulations (in the second column); and

(b) is of an age specified in that item (in the third column),

is the rate specified in that item (in the fourth column) in relation to the age of the officer in the third column.

Certain officers of Third Division to be paid at rates applicable to officers of Fourth Division.

8. The rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies an office in the Third Division specified or described in the table in this sub-regulation is the rate at which, or the scale of rates in accordance with which, salary is payable under regulation 10 of these Regulations to an officer who occupies an office in the Fourth Division having the same designation or description.

Allowances payable to certain officers and employees of Third Division.

9.—(1.) Where an officer occupies, or an officer or employee performs the duties of, an office in the Third Division specified or described in an item in Part I. of the Second Schedule to these Regulations (in the second column), an allowance is payable to the officer or employee as provided in the item (in the third column).

(2.) Where an officer occupies, or an officer or employee performs the duties of, an office in the Third Division and the officer or employee has the qualification referred to in sub-paragraph (a) of paragraph 1 of Part II. of the Second Schedule to these Regulations, an allowance is payable to the officer or employee as provided in that Part.

(3.) Where—

(a) an officer occupies, or an officer or employee performs the duties of, an office in the Third Division of Teacher in the Department of Education and Science or Teacher, Grade 1;

(b) the officer or employee has been admitted, or is eligible to be admitted, to a degree of an Australian university or to a degree of an overseas university, being a degree that is of a standard at least equal to the standard of a degree conferred by an Australian university; and

(c) the officer or employee has been in receipt of salary at the maximum rate applicable to the office he occupies, or is performing the duties of, for a period specified in the first column of the table in this sub-regulation,

the officer or employee shall be paid an allowance at the rate specified in the second column of that table in relation to the period in the first column.

Salaries payable to officers, of Fourth Division—general scales.

10.—(1.) Subject to sub-regulations (1.), (2.), (3.) and (5.) or the next succeeding regulation and to sub-regulations (1.), (2.). (3.) and (5.) of regulation 12 of these Regulations, the rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies on office in the Fourth Division specified or described in the first column of Part I. of the Third Schedule to these Regulations is, for the purposes of sub-section (2.) of section 30 of the Act, the rate, or scale of rates, specified in the second column of that Part in relation to that office.

(2.) For the purposes of sub-section (2.) of section 30 of the Act, the rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies an office in the Fourth Division specified in the first column of Part II of the Third Schedule to these Regulations is, subject to sub-regulation (2.) of the next succeeding regulation, the rate, or scale of rates, specified in the second column of that Part in relation to that office.

(3.) For the purposes of sub-section (2.) of section 30 of the Act, the rate at which, or the scale of rates in accordance with which, salary is payable to a male officer who occupies an office in the Fourth Division specified in the first column of the following table is the rate, or scale of rates, specified in the second column in relation to that office:—

(4.) For the purposes of sub-section (2.) of section 30 of the Act—

(a) the rate at which salary is payable to a female officer who occupies an office in the Fourth Division specified in the first column of the table in the last preceding sub-regulation, being an office in relation to which a rate is specified in the second column of that table, is the rate that is Four hundred and twenty-eight dollars less than the rate specified in the second column of that table in relation, to that office in the first column; and

(b) the scale of rates in accordance with which salary is payable to a female officer who occupies an office in the Fourth Division specified in the first column of that table, being an office in relation to which a scale of rates is specified in the second column of that table, is the scale of rates each of the rates of which is Four hundred and twenty-eight dollars less than the corresponding rate in the scale of rates specified in the second column of that table in relation to that office in the first column.

Minimum salaries payable to officers of Fourth Division—according to age.

11.—(1.) Where an officer—

(a) was not an employee immediately before he was appointed an officer;

(b) occupies, immediately after being appointed an officer, an office in the Fourth Division specified in Table A in this sub-regulation; and

the minimum rate at which salary is payable to the officer while he continues to occupy the office is the rate specified in the second column of Table B in this sub-regulation in relation to the age of the officer in the first column of that table.

(2.) Subject to the next succeeding regulation, for the purposes of subsection (2.) of section 30 of the Act, the rate at which salary is payable to an officer who—

(a) occupies an office in the Fourth Division specified in an item in Part III. of the Third Schedule to these Regulations (in the second column); and

(b) is of an age specified in that item (in the third column),

is the rate specified in that item (in the fourth column) in relation to the age of the officer in the third column.

(3.) Where an officer—

(a) occupies one of the following offices in the Fourth Division:—

(i) Assistant, Grade 1;

(ii) Clerical Assistant, Grade 1; or

(iii) Junior Assistant;

(b) is of an age specified in the first column of the table in this sub-regulation; and

(i) English and three other subjects at a standard not less than that known as Ordinary Level at an examination conducted by or on behalf of the Department of Education of the State of New South Wales at the end of the third year of secondary education in that State and held in a particular year or at two examinations so conducted and held in two successive years; or

(ii) English and three other subjects at an equivalent standard in an examination equivalent to that examination held in a particular year or at two examinations equivalent to that examination held in two successive years,

the rate at which salary is payable to the officer is the rate specified in the second column of that table in relation to the age of the officer specified in the first column of that table.

(4.) For the purpose of sub-paragraph (ii) of paragraph (c) of the last preceding sub-regulation, a pass in English expression or English literature at a standard and in an examination referred to in that sub-paragraph shall be deemed to be a pass in English at such a standard and in such an examination.

(5.) Where an officer—

(a) occupies one of the following offices in the Fourth Division:—

(i) Assistant, Grade 1;

(ii) Clerical Assistant, Grade 1; or

(iii) Junior Assistant;

(b) is of an age specified in the first column of the table in this sub-regulation; and

the rate at which salary is payable to the officer is the rate specified in the second column of that table in relation to the age of the officer specified in the first column of that table.

Salaries payable to officers of Fourth Division who are apprentices or trainees.

12.—(1.) Subject to the next succeeding sub-regulation, where—

(a) an officer occupies an office in the Fourth Division specified in the first column of the table in this sub-regulation;

(b) the officer has served in that office for a period specified in the second column of that table in relation to the designation of the office in the first column; and

(c) the rate specified in the third column of that table in relation to that period of service in the second column is higher than the rate that, but for this sub-regulation, would be the rate at which salary is payable to the officer,

the rate at which salary is payable to the officer, is for the purposes of subsection (2.) of section 30 of the Act, the rate so specified in that table.

(2.) The last preceding sub-regulation does not apply to an officer who—

(a) occupies an office of Apprentice in the Fourth Division; and

(b) is indentured to serve as an apprentice for a period of four years.

(3.) Where the rate at which salary would, but for this sub-regulation, be payable to an officer referred to in the last preceding sub-regulation under Part III. of the Third Schedule to these Regulations is less than the rate specified in the second column of the table in this sub-regulation in relation to the period of service of the officer in the office of Apprentice in the first column, the rate at which salary is payable to the officer is the rate so specified.

(4.) For the purposes of the last preceding sub-regulation, where an officer referred to in that sub-regulation is entitled in accordance with the indenture to the credit of a period of the term of his apprenticeship, the officer shall be deemed to have served for that additional period in the office of Apprentice.

(5.) Where the rate at which salary would, but for the sub-regulation, be payable to an officer who—

(a) occupies one of the following offices in the Fourth Division:—

(i) Apprentice Electrical Tradesman;

(ii) Apprentice Telecommunications Tradesman; or

(iii) Apprentice Tradesman (Radio); and

(b) has not attained the age of twenty-one years,

is less than the rate specified in the second column of the table in this sub-regulation in relation to the period of service of the officer in that office in the first column of that table, the rate at which salary is payable to the officer is the rate so specified in that table.

(6.) Where an officer occupies an office of Student Nurse in the Department of Health, Northern Territory, the rate at which salary is payable to the officer is—

(a) if the officer has not attained the age of twenty-one years, the rate specified in the second column of the following table in relation to his period of service in the office in the first column; or

(b) if the officer has attained the age of twenty-one years, the rate specified in the, third column of the following table in relation to his period of service in the office in the first column:—

Allowances payable to certain officers of Fourth Division.

13.—(1.) Where an officer—

(a) occupies one of the following offices in the Fourth Division:—

(i) Computing Assistant;

(ii) Drafting Assistant, Grade 1;

(iii) Illustrating Assistant, Grade 1;

(iv) Plan Records Assistant, Grade 1; or

(v) Technical Assistant, Grade 1;

(b) is of an age specified in the first column of the table in this sub-regulation;

(d) is paid, under sub-regulation (2.) of regulation 11 of these Regulations, salary at a rate less than the rate specified in the second column of that table in relation to the age of the officer specified in the first column of that table,

the officer may be paid an allowance at a rate equal to the difference between the rate at which salary is payable to him under sub-regulation (1.) of regulation 10 of these Regulations and the rate so specified.

(2.) Where an officer occupies, or an officer or employee performs the duties of, an office in the Fourth Division specified or described in an item in the Fourth Schedule to these Regulations (in the second column), an allowance is payable to the officer or employee as provided in the item (in he third column).

Certain officers of Fourth Division to be paid at rates applicable to officers of Third Division.

14. The scale of rates in accordance with which salary is payable to an officer who occupies an office in the Fourth Division specified in the table in this sub-regulation is the scale of rates in accordance with which salary is payable under regulation 6 of these Regulations to an officer-occupying an office in the Third Division having the same designation

Part III.—Salaries and Allowances Payable to Officers Appointed as Unattached Officers of Second, Third or Fourth Division.

Salaries and allowances payable to unattached officers.

15.—(1.) The rate at which salary is payable to an unattached officer of the Second, Third or Fourth Division is, until he is transferred to an office in accordance with section 47 of the Act, the rate at which salary would be payable to him if he were occupying an office in that Division—

(a) that had a designation corresponding to that applicable to him as an unattached officer; and

(b) the duties applicable to which were substantially the same as his duties as an unattached officer.

(2.) An allowance payable under Part II. of these Regulations to an officer who occupies a particular office in a Division is payable, under the like conditions, to an unattached officer of that Division having a designation corresponding to the designation of that office.

(3.) In this regulation, “unattached officer” means an officer who was appointed to the Service as an unattached officer and has no; been transferred to an office in accordance with section 47 of the Act.

5	Teacher, Grade 1 ......................	1. He shall he paid an allowance at the rate of 225 dollars if—
		(a) he is associated with the teaching of Aboriginal children at a school provided specifically for the education of Aboriginal children, including such a school that also provides for, or provides a class for, the education of physically handicapped, mentally handicapped or physically and mentally handicapped Aboriginal children; or
		(b) he is teaching a class, or at a school, provided specifically for the education of physically handicapped, mentally handicapped or physically and mentally handicapped children, not being a class or a school referred to in the last preceding paragraph.
		2. Subject to the next succeeding paragraph, he shall, if he is in receipt of salary at a rate less than 6,442 dollars, be paid an allowance at a rate ascertained in accordance with the next succeeding paragraph while in charge of a primary school of the kind known as a one-teacher primary school, including such a school that also provides for the pre-primary education of children.
		3. For the purpose of the last preceding paragraph, the rate of the allowance is—
		(a) if he is in receipt of salary at a rate less than 5,993 dollars—the rate of 450 dollars; or
		(b) in any other case—a rate equal to the difference between 6,442 dollars and the rate of his salary.
		4. He shall be paid an allowance at the rate of 156 dollars while in charge of a school provided solely for the pre-primary education of children at which more than one Teacher, Grade 1 is employed.

8.	Telegraphist .................	1. Where—
		(a) he has passed an examination conducted by or on behalf of the Board for the purposes of this paragraph; and

Allowances Paid To Certain Officers of, and Employees in, the Third Division— continued

Part II,

1. Where—

(a) an officer of the Third Division has been admitted, or is eligible to be admitted, to a degree of an Australian university or to a degree of an overseas university, being a degree that is of a standard at least equal to the standard of a degree conferred by an Australian university; and

(b) salary is payable to the officer at a rate less, than the appropriate rate in relation to that officer,

the officer shall, subject to this Part, be paid an allowance at a rate equal to the difference between those rates.

2. Subject to the next succeeding paragraph, for the purpose of the last preceding paragraph, the appropriate rate, in relation to an officer who has been admitted, or is eligible to be admitted, by a University to a degree included in a class of degrees specified in an item (in the second column) in the following table, is the rate specified in that item (in the third column).

3. For the purpose of this Part, where—

(a) an officer has been admitted, or is eligible to be admitted, by a University to a degree included in the class of degrees specified in item 4 (in the second column) in the table in the last preceding paragraph;

(b) the officer has been admitted, or is eligible to be admitted, by a University to a further degree included in that class of degrees or has received, or is eligible to receive, a diploma or similar award of a University; and

(c) the periods of the courses for the first-mentioned degree and the other degree or the diploma or award aggregate not less than four years,

the appropriate rate, in relation to that officer, is the rate specified in item 3 (in the third column) in that table.

4. For the purpose of paragraph 1 of this Part, the rate at which salary is payable to an officer includes the rate at which an allowance (if any) under regulation 87 of the Public Service Regulations is payable to the officer.

		(b) he is in receipt of salary at a rate specified in the first column of the following table,
		he shall be paid an allowance at the rate specified in the second column of that table opposite to that rate in the first column.

		(b) he has performed efficiently all duties of that office; and

5	Assistant Postal Officer	1. If—
		(a) he has been an officer or employee for not less than the prescribed period; and
		(b) the duties performed by him are comparable with the duties of an Officer, Grade 1, of Mail Officer or of Postal Officer, Grade 2,
		he shall be paid an allowance at the rate at which an allowance would be payable to him under regulation 87 of the Public Service Regulations for the performance of those duties if he had, on the date been directed under regulation 116 of those Regulations to perform the duties of one of those offices.
		2. If he has been selected to undergo a course of training for the purposes of promotion to the offices of Postal Clerk and possesses the educational qualifications required for transfer from the Fourth Division to the Third Division, he shall, on and after the commencement of his training, be paid an allowance at the rate equal to the difference between the rate at which salary is payable to him and the rate specified to the second column of the following table in relation to his age specified in the first column of that table:—

5	Assistant Postal Officer—continued ..........	3. The allowance payable under the last preceding paragraph ceases to be payable if the officer fails to complete the requirements of the course of trailing satisfactorily.
		4. If—
		(a) he has been an officer or employee for not less than the prescribed period;
		(b) he is in receipt of the allowance referred to in the last preceding paragraph; and
		(c) the sum of the rate at which salary is payable to him and the rate at which the allowance is payable to him under that paragraph is less than the rate of salary that would be payable to him if he had been promoted to the office of Postal Officer, Grade 1,
		he shall, while he is paid the allowance referred to in the last preceding paragraph, be paid an additional allowance at the rate equal to the amount of the difference.
		5. For the purposes of paragraphs 1 and 4 of this item, the prescribed period in relation to an officer or employee is—
		(a) if his age on appointment or on becoming an employee was less than 17 years and 3 months—the period commencing on the date of his appointment and ending on the day on which he attains the age of 13 years and 6 months;
		(b) if, on appointment, he had attained the age of 17 years and 3 months but had not attained the age of 20 years and 9 months—the period of one year and 3 months commencing on the date of his appointment;
		(c) if, on appointment, he had attained the age of 20 years and 9 months but had not attained the age of 21 years—the period commencing on the date of his appointment and ending on the day on which he attains the age of 22 years; and
		(d) if on appointment, he had attained the age of 21 years—the period of 12 months commencing on the date of his appointment.
6	Boatman ...........................	1. He shall be paid an allowance at the rate of 64 dollars if he holds a Master’s Certificate, Rivers and Harbour, issued in accordance with, the law of a State or Territory of the Commonwealth.
		2. He shall be paid an allowance at the rate of 64 dollars if he holds an Engine-Driver’s Certificate issued in accordance with the law of a State or Territory of the Commonwealth.

		(a) he has passed all parts of the examination for the award of the Departmental Certificate in Prosthetics the passing of which ordinarily constitutes the completion of the first stage of the course;

		2 He shall be paid an allowance at the rate of 126 dollars in lieu of the allowance payable under paragraph 1 of this item if—
		(a) he satisfies the conditions specified in sub-paragraphs (a) (b) and (c) of the last preceding paragraph; and
		(b) he has passed all parts of the examination for the award of the Departmental Certificate in Prosthetics the passing of which ordinarily constitutes the completion of the second stage of the course.

		(a) he has passed a test conducted by or on behalf of the Board in typing at the rate of 50 words per minute and in typing letters and documents with due regard to punctuation and form; or
		(b) he is employed full time on the operation of a Varityper or I.B.M. Composer and has passed a test conducted by or on behalf of the Board for the purpose of this sub-paragraph.
		2. He shall be paid an allowance at the rate of 79 dollars per annum for each day on which he is employed solely on the transcription by typewriter of recorded dictation if—
		(a) he is in receipt of the allowance speeded in subparagraph (a) of the last preceding paragraph; and
		(b) he has passed, an examination, conducted by or on behalf of the Board for the purpose of this sub-paragraph.
