PUBLIC SERVICE (SALARIES) REGULATIONS

Part I.—Preliminary.

Citation.

1. These Regulations may be cited as the Public Service (Salaries) Regulations.

Parts.

2. These Regulations are divided into Parts, as follows:—

Part I.—Preliminary (Regulations 1-3).

Part II.—Salaries and Allowances payable to Officers of the Second, Third or Fourth Division (Regulations 4-13).

Part III.—Variations of Salaries of Officers of the Second, Third or Fourth Division (Regulations 14-15).

Part IV.—Salaries and Allowances payable to Officers appointed as Unattached Officers of the Second, Third or Fourth Division (Regulation 16).

Part V.—Miscellaneous (Regulation 17).

Interpretation.

3.—(1.) In these Regulations, unless the contrary intention appears, “rate” means rate per annum.

(2.) In these Regulations, a reference to salary or an allowance at the rate of a specified sum in dollars shall be read as a reference to salary or the allowance at the rate of that specified sum per annum.

Part II.—Salaries and Allowances Payable to Officers of the Second, Third or Fourth Division.

Salaries payable to officers of Second Division.

4. For the purposes of sub-section (2.) of section 30 of the Act, the rate at which salary is payable to an officer who occupies an office in the Second Division is the rate specified in the second column of the following table that is appropriate to that office having regard to its classification:—

Salaries payable to officers of Third Division— general scales.

5.—(1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies an office in the Third Division specified or described in the first column of Part I. of the First Schedule to these Regulations is, subject to sub-regulation (2.) of the next succeeding regulation, the rate, or scale of rates, specified in the second column of that Schedule in relation to that office.

(2.) For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates in accordance with which salary is payable to an officer who occupies an office in the Third Division to which there is allotted by its classification the minimum and maximum rates specified, respectively, in the second and third columns of Part II. of the First Schedule to these Regulations is, subject to sub-regulations (1.) and (2.) of the next succeeding regulation, the scale of rates specified in the fourth column of that Part in relation to those minimum and maximum rates.

(3.) For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates in accordance with which salary is payable to an officer who occupies. an office in the Third Division specified in the first column of Part III. of the First Schedule to these Regulations is, subject to sub-regulation (1.) of the next succeeding regulation, the scale of rates specified in the second column of that Part in relation to that office.

(4.) For the purposes of sub-section (2.) of section 30 of the Act, the rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies an office in the Third Division specified or described in the first column of Part IV. of the First Schedule to these Regulations is, subject to sub-regulation (3.) of the next succeeding regulation, the rate, or scale of rates, specified in the second column of that Part in relation to that office.

(5.) For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates in accordance with which salary is payable to an officer who occupies an office in the Third Division specified in the first column of Part V. of the First Schedule to these Regulations is the scale of rates specified in the second column of that Part in relation to that office.

(6.) For the purposes of sub-section (2.) of section 30 of the Act, the rate at which, or the scale of rates in accordance with which, salary is payable. to an officer who occupies an office in the Third Division specified or described in the first column of Part VI. of the First Schedule to these Regulations is, subject to sub-regulation (2.) of the next succeeding regulation, the rate, or scale of rates, specified in the second column of that Part in relation to that office.

Minimum salaries payable to officers of Third Division— according to age.

6.—(1.) Where an officer—

(a) was not an employee immediately before he was appointed an officer;

(b) occupies an office in the Third Division referred to in sub-regulation (2.) or (3.) of the last preceding regulation; and

the minimum rate at which salary is payable to the officer is the rate specified in the second column of that table in relation to the age of the officer in the first column.

(2.) For the purposes of sub-section (2.) of section 30 of the Act, the minimum rate at which salary is payable to an officer who—

(a) occupies an office in the Third Division specified or described in an item in Part VII, of the First Schedule to these Regulations (in the second column) ; and

(b) is of an age specified in that item (in the third column),

is whichever of the rates specified in that item (in the fourth column) in relation to the age of the officer in the third column is applicable to the officer,

(3.) For the purposes of sub-section (2.) of section 30 of the Act, the minimum rate at which salary is payable to an officer who—

(a) occupies an office in the Third Division specified in an item in Part VIII. of the First Schedule to these Regulations (in the second column) ; and

(b) is of an age specified in that item (in the third column),

is the rate specified in the item (in the fourth column) in relation to the age of the officer in the third column.

Certain officers of Third Division to be paid at rates applicable to officers of Fourth Division.

7. The rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies an office in the Third Division specified or described in the table in this sub-regulation is the rate at which, or the scale of rates in accordance with which, salary is payable under regulation 9 of these Regulations to an officer who occupies an office in the Fourth Division having the same designation, or description.

Allowances payable to certain officers and employees of Third Division.

8.—(1.) Where an officer occupies, or an officer or employee performs the duties of, an office in the Third Division specified or described in an item in Part I. of the Second Schedule to these Regulations (in the second column), an allowance is payable to the officer or employee as provided in the item (in the third column),

(2.) Where an officer occupies, or an officer or employee performs the duties of, an office in the Third Division and the officer or employee has the qualification referred to in sub-paragraph (a) of paragraph 1 of Part II. of the Second Schedule to these Regulations, an allowance is payable to the officer or employee as provided in that Part.

(3.) Where—

(a) an officer occupies, or an officer or employee performs the duties of, an office in the Third Division of Teacher in the Department of Education and Science or Teacher, Grade 1;

(b) the officer or employee has been admitted, or is eligible to be admitted, to a degree of an Australian university or to a degree of an overseas university, being a degree that is of a standard at least equal to the standard of a degree conferred by an Australian university; and

(c) the officer or employee has been in receipt of salary at the maximum rate applicable to the office he occupies, or is performing the duties of, for a period specified in the first column of the table in this sub-regulation,

the officer or employee shall be paid an allowance at the rate specified in the second column of that table in relation to the period in the first column.

Salaries payable to officers of Fourth Division— general scales.

9.—(1.) Subject to sub-regulations (1.), (2.), (4.) and (6.) of the next succeed-ing regulation and to sub-regulations (1.), (2.), (3,) and (5,) of regulation 11 and sub-regulation (1.) of regulation 12 of these Regulations, the rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies an office in the Fourth Division specified or described in. the first column of Part I. of the Third Schedule to these Regulations is, for the purposes of sub-section (2.) of section 30 of the Act, the rate, or scale of rates, specified in the second, column of that Part in relation to that office.

(2.) Subject to sub-regulation (3.) of the next suceeding regulation and sub-regulation (6.) of regulation 11 of these Regulations, the rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies an office in the Fourth Division specified or described in the first column of Part II. of the Third Schedule to these Regulations is, for the purposes of sub-section (2.) of section 30 of the Act, the rate, or scale of rates, specified in the second column of that Part in relation to that office.

(3.) For the purposes of sub-section (2.) of section 30 of the Act, the rate at which, or the scale of rates in accordance with which, salary is payable to an officer who occupies an office in the Fourth Division specified in the first column of Part III, of the Third Schedule to these Regulations is, subject to sub-regulation (2.) of the next succeeding regulation, the rate, or scale of rates, specified in the second column of that Part in relation to that office.

(4.) For the purposes of sub-section (2.) of section 30 of the Act, the rate at which, or the scale of rates in accordance with which, salary is payable to a male officer who occupies an office in the Fourth Division specified in the first column of the following table is the rate, or scale of rates, specified in the second column in relation to that office:—

(5.) For the purposes of sub-section (2.) of section 30 of the Act—

(a) the rate at which salary is payable to a female officer who occupies an office in the Fourth Division specified in the first column of the table in the last preceding sub-regulation, being an office in relation to which a rate is specified in the second column of that table, is the rate, that is Four hundred and twenty-eight dollars less than the rate specified in the second column of that table in relation to that. office in the first column. and

(b) the scale of rates is accordance with which salary is payable to a female officer who occupies an office in the Fourth Division specified in the first column of that table, being an office in relation to which a scale of rates is specified in the second column of that table, is the scale of rates each of the rates of which is Four hundred and twenty-eight dollars less than the corresponding rate in the scale of rates specified in the second column of that table in relation to that office in the first column,

Minimum salaries payable to officers of Fourth Division— according to age.

10.—(1.) Where an officer—

(a) was not an employee immediately before he was appointed an officer;

(b) occupies an office in the Fourth Division specified in Table A in this sub-regulation; and

the minimum rate at which salary is payable to the officer is the rate specified in the second column of Table B in this sub-regulation in relation to the age of the officer in the first column of that table.

(2.) For the purposes of sub-section (2.) of section 30 of the Act, the minimum rate at which salary is payable to an officer who—

(a) occupies an office in the Fourth Division specified in an item in Part IV. of the Third Schedule to these Regulations (in the second column); and

(b) is of an age specified in that item (in the third column),

is whichever of the rates specified in that item (in the fourth column) in relation to the age of the officer in the third column is applicable to the officer.

(3.) For the purposes of sub-section (2.) of section 30 of the Act, the minimum rate at which salary is payable to an officer who—

(a) occupies an office in the Fourth Division specified in an item in Part V. of the Third Schedule to these Regulations (in the second column); and

(b) is of an age specified in that item (in the third column), is the rate specified in that item (in the fourth column) in relation to the age of the officer in the third column.

(4.) Where an officer—

(a) occupies one of the following offices in the Fourth Division:—

(i) Assistant, Grade 1;

(ii) Clerical Assistant, Grade 1; or

(iii) Junior Assistant;

(b) is of an age specified in the first column of the table in this sub-regulation; and

(i) English and three other subjects at a standard not less than that known as Ordinary Level at an examination conducted by or on behalf of the Department of Education of the State of New South Wales at the end of the third year of secondary education in that State and held in a particular year or at two examinations so conducted and held in two successive years; or

(ii) English and three other subjects at an equivalent standard in an examination equivalent to that examination held in a particular year or at two examinations equivalent to that examination held in two successive years,

the rate at which salary is payable to the officer is whichever of the rates specified in the second column of that table in relation to the age of the officer specified in the first column of that table is applicable, to the officer.

(5.) For the purpose of sub-paragraph (ii) of paragraph (c) of the last preceding sub-regulation, a pass in English expression or English literature at a standard and in an examination referred to in that sub-paragraph shall be deemed to be a pass in English at such a standard and in such an examination.

(6.) Where an officer—

(a) occupies one of the following offices in the Fourth Division:—

(i) Assistant, Grade 1;

(ii) Clerical Assistant, Grade 1; or

(iii) Junior Assistant;

(b) is of an age specified in the first column of the table in this sub-regulation; and

Salaries payable to officers of Fourth Division who arc apprentices or trainees.

11.—(1.) Subject to the next succeeding sub-regulation, where—

(a) an officer occupies an office in the Fourth Division specified in the first column of the table in this sub-regulation;

(b) the officer has served in that office for a period specified in the second column of that table in relation to the designation of the office in the first column; and

(c) the rate specified in the third column of that table in relation to that period of service in the second column is higher than the rate that, but for this sub-regulation, would be the rate at which salary is payable to the officer,

the rate at which salary is payable to the officer, is, for the purposes of subsection (2.) of section 30 of the Act, the rate so specified in that table.

(2.) The last preceding sub-regulation does not apply to an officer who—

(a) occupies an office of Apprentice in the Fourth Division; and

(b) is indentured to serve as an apprentice for a period of four years.

(3.) Where the rate at which salary would, but for this sub-regulation, be payable to an officer referred to in the last preceding sub-regulation under Part IV. of the Third Schedule to these Regulations is less than the rate specified in the second column of the table in this sub-regulation in relation to the period of service of the officer in the office of Apprentice in the first column, the rate at which salary is payable to the officer is the rate so specified.

(4.) For the purposes of the last preceding sub-regulation, where an officer referred to in that sub-regulation is entitled in accordance with the indenture to the credit of a period of the term of his apprenticeship, the officer shall be deemed to have served for that additional period in the office of Apprentice.

(5.) Where the rate at which salary would, but for this sub-regulation, be payable to an officer who—

(a) occupies one of the following offices in the Fourth Division:—

(i) Apprentice Electrical Tradesman;

(ii) Apprentice Telecommunications Tradesman; or

(iii) Apprentice Tradesman (Radio); and

(b) has not attained the age of twenty-one years,

is less than the rate specified in the second column of the table in this sub-regulation in relation to the period of service of the officer in that office in the first column of that table, the rate at which salary is payable to the officer is the rate so specified in that table.

(6.) Where an officer—

(a) occupies an office of Student Nurse in the Department of Health, Northern Territory;

(b) has not attained the age of twenty-one years,

the rate at which salary is payable to the officer is the rate specified in. the second column of the following table in relation to his period of service in the office in the first column:—

Allowances payable to certain officers of Fourth Division.

12.—(1.) Where an officer—

(a) occupies one of the following offices in the Fourth Division:—

(i) Computing Assistant;

(ii) Drafting Assistant, Grade 1;

(iii) Illustrating Assistant, Grade 1;

(iv) Plan Records Assistant, Grade 1; or

(v) Technical Assistant, Grade 1;

(b) is of an age specified in the first column of the table in this sub-regulation;

(d) is paid, under sub-regulation (1.) of regulation 9 of these Regulations, salary at a rate less than whichever of the rates specified in the second column of that table in relation to the age of the officer specified in the first column of that table is applicable to him,

the officer may be paid an allowance at a rate equal to the difference between the rate at which salary is payable to him under sub-regulation (1.) of regulation 9 of these Regulations and the rate so specified,

(2.) Where an officer occupies, or an officer or employee performs the duties of, an office in the Fourth Division specified or described in an item in the Fourth Schedule to these Regulations (in the second column), an allowance is payable to the officer or employee as provided in the item (in the third column).

Certain officers of Fourth Division to be paid at rates applicable to officers of Third Division.

13. The scale of rates at which salary is payable to an officer who occupies an office in the Fourth Division specified in the table in this sub-regulation is the scale of rates in accordance with which salary is payable under regulation 5 of these Regulations to an officer occupying an office in the Third Division having the same designation,

Part III.—Variations of Salaries of Officers of the Second, Third or Fourth Division.

Application.

14. In the application of these Regulations in relation to the service of an officer during the period from and including the date of commencement of these Regulations to and including the day immediately preceding the first day of the first pay period commencing on or after the first day of January, 1972, or during a part of that period, the provisions of Part 11. of these Regulations apply subject to the provisions of this Part.

Variations of salary— female officers.

15.—(1.) Where an adult female officer occupies, during the period from and including the date of commencement of these Regulations to and including the day immediately preceding the first day of the first pay period commencing on or after the first day of January, 1972, or during a part of that period—

(a) an office in the Second Division; or

(b) an office in the Third Division specified or referred to in sub-regulation (1.), (2.), (3.), (5.) or (6.) of regulation 5, sub-regulation (1.) of regulation 6 or regulation 7 of these Regulations,

the rate at which salary is payable to her in respect of service in that office during that period or part of that period is—

(c) the rate that is Four hundred and twenty-eight dollars less than the rate at which salary would, but for this sub-regulation, be payable to her; or

(d) the rate equal to ninety-five per centum of the rate at which salary would, but for this sub-regulation, be payable to her,

whichever is the higher rate.

(2.) Where an adult female officer occupies, during the period from and including the date of commencement of these Regulations to and including the day immediately preceding the first day of the first pay period commencing on or after the first day of January, 1972, or during a part of that period, an office in the Fourth Division specified or referred to in sub-regulation (1.) or (3.) of regulation 9, sub-regulation (1.) of regulation 10 or regulation 13 of these Regulations, the rate at which salary is payable to her in respect of service in that office during that period or part of that period is—

(a) the rate that is Four hundred and twenty-eight dollars less than the rate at which salary would, but for this sub-regulation, be payable to her; or

(b) the rate equal to ninety-five per centum of the rate at which salary would, but for this sub-regulation, be payable to her,

whichever is the higher rate.

Part IV.—Salaries and Allowances Payable to Officers Appointed as Unattached Officers of Second, Third or Fourth Division.

Salaries and allowances payable, to unattached officers.

16.—(1.) The rate at which salary is payable to an unattached officer of the Second, Third or Fourth Division is, until he is transferred to an office in accordance with section 47 of the Act, the rate at which salary would be payable to him if he were occupying an office in that Division—

(a) that had a designation corresponding to that applicable to him as an unattached officer; and

(b) the duties applicable to which were substantially the same as his duties as an unattached officer,

(2.) An allowance payable under Part II. of these Regulations to an officer who occupies a particular office in a Division is payable, under the like conditions, to an unattached officer of that Division having a designation corresponding to the designation of that office.

(3.) In this regulation, “unattached officer” means an officer who was appointed to the Service as an unattached officer and has not been transferred to an office in accordance with section 47 of the Act.

17. The Public Service Regulations are incorporated, and shall be read as one, with these Regulations.

(a) an officer of the Third Division has been admitted, or is eligible to be admitted to a degree of an Australian university or to a degree of an overseas university being a degree that is of a standard at least equal to the standard of a degree conferred by. an Australian university; and

(b) salary is payable to the officer at a rate less than the appropriate rate in relation to that officer,

the officer shall, subject to this Part, be paid an allowance at a rate equal to the difference between those rates.

2. Subject to the next succeeding paragraph, for the purpose of the last preceding paragraph, the appropriate rate, in relation to an officer who has been admitted, or is eligible to be admitted, by a University to a degree included in a class of degrees specified in an item (in the second column) in the following table, is the rate specified in that item (in the third column)

3. For the purpose of this Part, where—

(a) an officer has been admitted, or is eligible to be admitted, by a University to a degree included in the class of degrees specified in item 4 (in the second column) in the table in the last preceding paragraph;

(b) the officer has been admitted, or is eligible to be admitted, by a University to a further degree included in that class of degrees or has received, or is eligible to receive, a diploma or similar award of a University; and

(c) the periods of the courses for the first-mentioned degree and the other degree or the. diploma or award aggregate not less than four years,

the appropriate rate, in relation to that officer, is the rate specified in item 3 (in the third column) in that table.

4. For the purpose of paragraph 1 of this Part, the rate at which salary is payable to an officer includes the rate at which an allowance (if any) under regulation 87 of the Public Service Regulations is payable to the officer.

3	Apprentice.......................	1. He shall, if he obtains a pass in each of the subjects at an examination for apprentices held at the end of a year of his course of training, be paid an allowance at the rate of 26 dollars in respect of the period of 12 months commencing on the beginning of the first pay period commencing in January in the next succeeding year.

		2. 4	Assistant Photographer...............	He shall be paid an allowance at the rate of 403 dollars if—
		(a) he has completed two years’ service in the office of Assistant Photographer;
		(b) he has performed efficiently ail duties of that office; and
		(c) he has not attained the age of 21 years.
5	Assistant (Post-mortem)..............	He shall be paid an allowance at the rate of 104 dollars if he holds a Diploma in Mortuary Hygiene and Technology awarded by the Royal Institute of Public Health and Hygiene, London.
6	Assistant Postal Offices...............	1. If—
		(a) he has been an officer or employee for not less than the prescribed period; and
		(b) the duties performed by him are comparable with the duties of an office of Postman, of Postal Officer, Grade I, of Mail Officer or of Postal Officer, Grade 2.
		he shall be paid an allowance at the rate at which an allowance would be payable to him under regulation 87 of the Public Service Retaliations for the performance of those duties if he had, on the date, been directed under regulation 116 of those Regulations to perform the duties of one of those offices.

7	Boatman.........................	1. He shall be paid an allowance at the rate of 64 dollars if he holds a Master’s Certificate, Rivers and Harbour, issued in accordance with the law of a State or Territory of the Commonwealth.
		2. He shall he paid an allowance at the rate of 64 dollars if he holds an Engine-Driver’s Certificate issued in accordance with the law of a State or Territory of the Commonwealth.
8	Canteen Assistant...................	He shall, while employed as first assistant to the Canteen Manager, Repatriation Department, New South Wales or Victoria, be paid an allowance equal to the difference between his salary and the salary which would be payable to him from time to time if the scale of rates of salary of the office were 3,165-3,255-3,329 dollars.
9	Card Punch Operator, Grade 1...........	He shall be paid an allowance at the rate of 119 dollars on passing a test conducted by or on behalf of the Board for the purpose of this paragraph.
10	Clerical Assistant, Grade 3.............	He shall, if he is performing the duties of an office in the Department of Health, be paid an allowance at the rate of 61 dollars per annum for each day on which he is employed solely on checking medical prescriptions in respect of treatment the cost of which is paid for under the Repatriation Act 1920-1971.

He shall, if the rate of his salary does not exceed 4,646 dollars, be paid an allowance at the rate of 104 dollars in respect of each post-graduate nursing certificate (other than a certificate issued by a College referred to in the last preceding paragraph) recognized by the Board, having regard to the nature of the training in respect of which the certificate was issued, if he performs duties of the kind to which the certificate relates.

46	Typist...........................	1. He shall be paid an allowance at the rate of 119 dollars if he is not entitled to an allowance under paragraph 3 of this item and—
		(a) he has passed a test conducted by or on behalf of the Board in typing at the rate of 50 words per minute and in typing letters and documents with due regard to punctuation and form; or
		(b) he is employed full time on the operation of a Verityper and has passed a test conducted by or on behalf of the Board for the purpose of this sub-paragraph.
		2. He shall be paid an allowance at the rate of 79 dollars per annum for each day on which he is employed society on the transcription by typewriter of recorded dictation if—
		(a) he is in receipt of the allowance specified in sub-paragraph (a) of the last preceding paragraph; and
		(b) he has passed an examination conducted by or on behalf of the Board for the purpose of this sub-paragraph.
		3. He shall be paid an allowance at the rate specified in the second column of the table in this paragraph in relation to the highest speed in words per minute specified in the first column of that table at which he has passed a test conducted by or on behalf of the Board in writing shorthand and in correctly transcribing that shorthand.
