Overview

The Statutory Rules 1973 No. 34, enacted on 23 January 1973, amends the Public Service Regulations under the Public Service Act 1922-1972. This regulation was introduced to address the need for updating qualifications required for certain public service roles, specifically for transfers or promotions from the Fourth Division to the Third Division. The Public Service Board, acting with the authority conferred by the Public Service Act, made these amendments to reflect changes in educational qualifications, particularly recognising degrees from colleges of advanced education. These amendments were approved by the Governor-General, Paul Hasluck, on 8 February 1973, ensuring they align with the broader objectives of the Public Service Act and provide clarity regarding qualifications for public service roles.

Scope and Application

The Statutory Rules 1973 No. 34, made under the Public Service Act 1922-1972, amend the Public Service Regulations to modify the conditions for transfer or promotion from the Fourth Division to the Third Division. These regulations apply to individuals within the Commonwealth public service who meet the specified criteria for transfer or promotion, particularly those who have attained a degree from an Australian college of advanced education or a similar institution. The amendment clarifies the definition of "college of advanced education" to mean an institution within the scope of the Australian Commission on Advanced Education Act 1971. This regulation thus extends to all public service employees who are eligible for promotion based on their educational qualifications, with the amendment specifically enhancing the scope of recognised educational institutions. The changes are geographically limited to the Commonwealth level, affecting public servants employed by the federal government. The regulation does not specify any exclusions, exemptions, or thresholds beyond those already defined in the Public Service Regulations. The application of these regulations can be further detailed or refined through subordinate instruments, though the primary changes are explicitly stated in the legislative instrument itself.

Key Provisions

The operative sections of the regulation primarily focus on amending Regulation 112 of the Public Service Regulations. Specifically, section (a) of the regulation modifies paragraph (c) of sub-regulation (1) by inserting the words "of an Australian college of advanced education or" after the term "degree," thereby expanding the types of degrees recognised for transfer or promotion purposes. Additionally, section (b) introduces a new sub-regulation (1aa) that defines "college of advanced education" to mean a college of advanced education as defined under the Australian Commission on Advanced Education Act 1971. This amendment ensures that qualifications from colleges of advanced education are recognised for career progression within the public service. The Public Service Board, under the authority of the Public Service Act 1922-1972, imposes certain obligations on public servants and the Board itself. Public servants must now meet the updated criteria for qualifications when seeking transfer or promotion from the Fourth Division to the Third Division. This includes holding a degree from an Australian college of advanced education, in addition to other recognised qualifications. The Board is also obligated to implement and enforce these new conditions as part of their regulatory duties. There are no explicit offences, penalties, or civil/criminal consequences mentioned in the regulation for failing to comply with the new conditions for transfer or promotion. However, the regulation's amendments reflect a formal process that public servants and the Board must follow. Non-compliance could potentially lead to administrative actions, such as denial of transfer or promotion, as the Board enforces adherence to the Public Service Regulations. The regulation, however, does not detail specific penalties for such non-compliance beyond the implications of not meeting the qualification criteria.
