Overview

The Public Service Regulations 1973, enacted under the Public Service Act 1922-1973, were created to address the need for updating and refining the conditions governing the transfer and promotion of officers within the public service, particularly within the Fourth Division to the Third Division. The Public Service Board, acting on the authority conferred by the Public Service Act, developed these regulations to ensure that the qualifications and criteria for such transfers and promotions were kept current and relevant. The regulations were approved by the Governor-General and came into effect on 1 July 1974. The objective of these amendments was to modernise the qualification requirements, ensuring that the public service could adapt to changing educational standards and maintain a competent workforce.

Scope and Application

The Statutory Rules 1973 No. 280, being regulations made under the Public Service Act 1922-1973, apply to officers within the Australian Public Service (APS). These regulations specifically amend the Public Service Regulations, affecting the conditions for transfer or promotion from the Fourth Division to the Third Division. The amendments remove certain qualifications previously required for such promotions, effective from 1 July 1974. Notably, officers who were continuously employed as of 30 June 1974 and met the qualifications as per the regulations in force on that date are still considered to hold the appropriate qualifications for transfer or promotion, despite the amendments. The regulations have a national reach, applying across all jurisdictions within Australia, and their scope is limited to the amendments specified within the document. There are no stated exclusions or exemptions, and the application is direct without the need for subordinate instruments to extend or restrict it.

Key Provisions

The primary operative sections of these Regulations pertain to the amendment of the Public Service Regulations, specifically addressing the conditions for transfer or promotion from the Fourth Division to the Third Division. Regulation 2(1) amends Regulation 112 of the Public Service Regulations by removing certain educational qualifications from the table in sub-regulation (i). This change effectively excludes the "School Leaving Examination", "Leaving Technical Examination", "Girls’ Secondary Schools Leaving Certificate", and "Victorian Technical College First Year Examination held before the year 1965" as acceptable qualifications for transfer or promotion to the Third Division. However, Regulation 2(2) stipulates that officers who were continuously serving on 30 June 1974 and held the appropriate qualifications for transfer or promotion under the old regulation continue to hold those qualifications, even after the amendments. These Regulations impose certain obligations on officers within the public service who seek to transfer or promote to the Third Division. Officers who were continuously serving on 30 June 1974 and held the appropriate qualifications under the previous regulation retain their eligibility for promotion. Conversely, officers who did not hold the requisite qualifications by that date must meet the new criteria specified in the amended regulation. This includes ensuring they possess educational qualifications that are acceptable under the updated conditions set out in Regulation 112. Failure to comply with the amended conditions for transfer or promotion could result in officers being ineligible for promotion to the Third Division. While the Regulations themselves do not explicitly detail specific offences, penalties, or consequences for non-compliance, the broader Public Service Act 1922-1973 may provide for disciplinary actions against officers who do not meet the criteria for promotion. Such actions could include denial of promotion, reassignment, or other administrative penalties as deemed appropriate by the Public Service Board. The exact nature and severity of these penalties would be governed by the overarching legislative framework rather than the specific Regulations.
