Overview

The Statutory Rules 1971 No. 1436, issued under the Public Service Act 1922-1968, represents amendments to the Public Service Regulations. Enacted by the Public Service Board and subsequently approved by the Governor-General, these regulations address the need to update and refine the public service framework in Australia. The amendments introduced in this legislative instrument are designed to align the public service regulations with contemporary requirements and operational standards, ensuring efficiency and effectiveness within the public sector. This regulatory update underscores the commitment to maintaining a responsive and capable public service infrastructure that meets the evolving needs of the nation. The enactment of these regulations by the Public Service Board, acting on the authority conferred by the Public Service Act 1922-1968, reflects a legislative intent to streamline public service operations and address any identified gaps in existing regulations. The approval by the Governor-General signifies the formal endorsement of these amendments, which are intended to enhance the functionality and adaptability of the public service framework. The regulations were notified in the Commonwealth Gazette on 1 February 1971, marking their official implementation.

Scope and Application

The Public Service Regulations 1971, made under the Public Service Act 1922-1968, pertain to the public service within the Commonwealth of Australia. These regulations govern the appointment, remuneration, and other conditions of employment for public service officers, including those in the newly introduced roles of Theatre Assistant and Senior Theatre Assistant, as outlined in the First Schedule. The scope of these regulations is specifically focused on the public service sector and applies to all officers within this sector, establishing clear guidelines and conditions pertinent to their employment. The amendments outlined in the First and Second Schedules ensure that the regulations remain up-to-date with the evolving needs and roles within the public service. These regulations are subject to the approval of the Governor-General and are intended to maintain a structured and consistent framework for public service employment in the Commonwealth.

Key Provisions

The main operative sections of this statutory instrument (C2004L01436) involve amendments to the Public Service Regulations under the Public Service Act 1922-1968. Specifically, the Regulations introduce new classifications for positions within the public service, adding a new group named "Theatre Assistant" (section 1 of the First Schedule) and modifying the existing salary scale for these positions. Additionally, it removes an existing item from the Second Schedule (section 2), although the details of this item are not specified within the text provided. The obligations and requirements imposed by these regulations are primarily administrative, focusing on the classification and remuneration of public service roles. For instance, the insertion of Group 398a specifies new roles and their corresponding salary brackets, which must now be adhered to when employing or promoting individuals within these positions. The removal of Item 15a from the Second Schedule signifies a revision in the classification criteria or job descriptions, necessitating updates to relevant personnel records or job postings. In terms of legal consequences, the text does not explicitly outline any offences, penalties, or civil/criminal consequences for breaching these regulations. However, non-compliance with public service regulations could potentially lead to administrative sanctions, including disciplinary action against public service officers or entities failing to adhere to the updated classifications and salary scales. Such actions might include corrective measures or financial penalties, although the specific details of these consequences would need to be referred to in other sections of the Public Service Act 1922-1968 or subsequent amendments.
