Overview

The Statutory Rules 1974 No. 223, made under the Public Service Act 1922-1974, were enacted to amend the existing Public Service Regulations. These regulations, approved by the Governor-General and effective from November 1974, address the need for updated allowances for public service employees who use their private vehicles for official purposes. The Public Service Board, acting with authority conferred by the Public Service Act, introduced these amendments to ensure that the rates for vehicle usage reflect current conditions, providing clear and updated guidelines for reimbursements. This legislative instrument was essential in maintaining the efficiency and fairness of the public service by addressing discrepancies and ensuring that the regulations remain relevant and practical for the employees' needs.

Scope and Application

The Statutory Rules 1974 No. 223, titled "Regulations Under the Public Service Act 1922-1974," made by the Public Service Board and approved by the Governor-General, outlines amendments to the Public Service Regulations. These regulations apply to employees of the Australian Public Service who use their private vehicles for official purposes. The specified amendments relate to the allowance payable for the use of private vehicles, with detailed rates per kilometre based on the type and engine capacity of the vehicle. This amendment does not extend to travel undertaken in a motor vehicle before the commencement of these Regulations. The regulations are applicable nationwide, as they are made under the Public Service Act, which has a Commonwealth reach, thereby affecting federal public service employees across Australia. No specific exclusions or exemptions are noted in the text, but the application is confined to travel undertaken after the effective date of the regulations. The regulations are intended to standardise the allowance rates for different types of vehicles used for official purposes by public servants.

Key Provisions

The key provisions of the statutory rules amend the Public Service Regulations, particularly focusing on allowances for the use of private vehicles for official purposes. Regulation 90 now details the rates of payment per kilometre for various types of vehicles used for official travel, distinguishing between different capacities and engine sizes (Reg. 1). Additionally, Regulation 90a outlines the rates for specified journeys, again categorising vehicles by capacity and engine size (Reg. 2). It is crucial to note that these amendments do not apply to travel undertaken before the commencement of these Regulations (Reg. 3). These Regulations impose specific obligations on public service employees who use their private vehicles for official purposes. Employees must adhere to the prescribed rates of payment per kilometre as outlined in the amended Regulations. This includes maintaining accurate records of the kilometres travelled and ensuring that claims for reimbursement are submitted in accordance with the specified rates. The Regulations also require public service employees to use their vehicles exclusively for official purposes when claiming allowances, ensuring transparency and accountability in the reimbursement process. Failure to comply with the provisions of these Regulations may result in civil or criminal consequences, although the specific penalties are not detailed within the text. Generally, non-compliance with public service regulations can lead to disciplinary actions, including potential fines or other administrative penalties. For more severe breaches, criminal charges may be pursued, particularly if there is evidence of fraud or significant misuse of public funds. However, the exact penalties and consequences for breaches of these particular Regulations would need to be referred to other relevant legislation or administrative guidelines.
