Overview

The Statutory Rules 1964, No. 147, Regulations under the Public Service Act 1922-1964, were introduced by the Public Service Board and subsequently approved by the Governor-General in accordance with the Federal Executive Council's advice. These regulations, dated 10th November 1964, are aimed at amending the existing Public Service Regulations to address specific issues related to the payment and allowances of officers within the public service. The primary objective of these amendments is to ensure the accurate calculation of pay, allowances, and overtime for officers performing duties at the Royal Australian Mint, as well as to adjust certain pay rates to reflect the changes in the allowances. This legislative instrument is essential for maintaining a fair and equitable compensation system within the public service sector.

Scope and Application

The Regulations Under the Public Service Act 1922-1964, as amended by Statutory Rules 1964, No. 147, apply to officers within the Commonwealth public service, specifically those working at the Royal Australian Mint. These regulations concern the amendment of pay, furlough, holiday duty, overtime, higher duties, and the introduction of a mint allowance. The amendments aim to address specific salary-related issues for employees at the Royal Australian Mint, including adjustments to allowances and rates of pay for various positions. The regulations also include provisions for the calculation of salary for duties performed on holidays and the recording and payment for overtime. The scope of these regulations is limited to the Commonwealth level and does not extend to state or territory public services. Notably, the regulations specify allowances for certain roles at the Royal Australian Mint, and these allowances are subject to the conditions outlined in the amended regulations. The application of these regulations is further governed by subordinate instruments, which may include additional specifications or clarifications to ensure proper implementation.

Key Provisions

The regulations primarily amend the Public Service Regulations by introducing changes to pay, furlough, and overtime provisions, as well as introducing a new allowance for certain employees at the Royal Australian Mint. Regulation 51e (j) now includes an additional allowance, and Regulation 62 has been amended to clarify that the allowance under regulation 94a is included in the calculation of furlough pay. Regulation 63 has been modified to ensure that the annual actual salary for calculating pay on holidays includes this allowance. Furthermore, Regulation 67 has been updated to adjust the overtime rate from thirteen shillings to eighteen shillings and sixpence. The new provisions also include detailed rules for calculating allowances when officers perform duties of a higher-classified office, as outlined in Regulations 87 (20), (21), and (22). Finally, a new Regulation 94a has been introduced, specifying an allowance for certain employees at the Royal Australian Mint, with rates detailed in a table appended to the regulation. These amendments impose specific obligations on public service officers and the Public Service Board. Officers who perform duties of a higher-classified office must have their salary rates adjusted accordingly for calculating allowances. The Public Service Board is responsible for ensuring that these amendments are properly implemented and that employees are paid the correct allowances as per the updated regulations. Employers must also record and approve overtime hours correctly and adjust pay calculations to include the new allowance when necessary. Breaching these regulations may result in legal consequences for both officers and employers. Failure to correctly calculate and pay allowances, furlough, or overtime could lead to disputes and potential legal action. The specific penalties for such breaches are not explicitly stated in the regulations, but they could include financial penalties or other corrective actions as determined by the Public Service Board or relevant authorities. It is essential for all parties to comply with these regulations to avoid any legal repercussions.
