Overview

The Public Service Regulations 1966 are amendments to the Public Service Regulations under the Public Service Act 1922-1964. These regulations were enacted by the Public Service Board and approved by the Governor-General in pursuance of the authority conferred upon them by the Public Service Act. The primary purpose of these amendments is to update and refine the salary structure for officers within the Second, Third, and Fourth Divisions of the Public Service, ensuring that their salaries are aligned with the specified increases as outlined in regulation 106a. This adjustment addresses discrepancies in the salary scales for male and female officers, providing a more equitable remuneration system based on age and specific roles within the public service. The amendments made to the Public Service Regulations aim to provide clarity and consistency in the calculation of salaries and allowances for various classes of officers. By incorporating the new sub-regulations and amendments to existing regulations, these changes ensure that the salaries and allowances are accurately calculated and reflect the intended increases, thereby maintaining the integrity and fairness of the public service remuneration system.

Scope and Application

The Statutory Rules 1966, No. 112, made under the Public Service Act 1922-1964, provide amendments to the Public Service Regulations. These amendments focus primarily on salary variations and adjustments for officers in the Second, Third, and Fourth Divisions within the Commonwealth public service, excluding those in the First Division and specific offices outlined in Group 1 of the Fourth Schedule. The regulations detail specific increases in annual salary based on age and gender for male and female officers, as well as adjustments for officers in certain roles such as Accounting Machinist (Female), Card Punch Operator (Female), Typist (Female), Apprentice, Technician-in-training, Technician-in-training (Electrical), and Technician-in-training (Radio). The changes also apply to officers who have not yet attained the age of twenty-one and those in specific roles like Seaman (Ordinary). These amendments are effective nationally within the Commonwealth jurisdiction and are subject to the approval of the Governor-General.

Key Provisions

The primary operative sections of the Regulations under the Public Service Act 1922-1964 (Sections 1-9) amend various parts and sub-regulations to introduce variations in the salaries of officers in the Second, Third, and Fourth Divisions, along with adjustments to how salaries are calculated and paid. Regulation 2 introduces Part V, which pertains to salary variations, and Regulation 3 modifies the interpretation of salary rates to reflect increases as per Regulation 106a. Regulation 63 adjusts the definition of "annual salary" to include salary increases according to Regulation 106a. Regulation 67 further specifies the inclusion of these increases in overtime calculations. Regulation 87b changes the reference from "salary" to "actual salary" and defines this term to include salary increases and allowances. Regulation 106a details the specific salary increases for different classes of officers based on age and gender, while Regulation 106b modifies the salary of unattached officers to include any increases from Regulation 106a. Lastly, Regulations 8 and 9 update the Second and Fifth Schedules to align with the new salary definitions. The Regulations impose several obligations on the relevant parties. Firstly, they mandate that salary rates for officers in the Second, Third, and Fourth Divisions be adjusted according to the detailed schedule in Regulation 106a, which varies increases based on age and gender. The Public Service Board is required to ensure these adjustments are properly implemented and recorded. Additionally, these Regulations require that "annual salary" and "actual salary" definitions in various sub-regulations include any salary increases per Regulation 106a, affecting calculations for duty on holidays, overtime, and allowances. The Regulations also require that certain officers, such as those appointed as unattached officers, do not receive further salary increases under Regulation 106a if they already qualify for an increase under another regulation. Failure to comply with these Regulations can result in various consequences. While the document does not explicitly state offences, penalties, or specific consequences for non-compliance, it is reasonable to infer that non-compliance could lead to legal action. For example, incorrect salary calculations could result in financial discrepancies, potentially leading to civil litigation for damages. Additionally, the Public Service Board could face disciplinary actions or administrative penalties for failing to enforce the Regulations correctly. The maximum penalties would depend on the specific nature of the breach and would likely be determined in the context of applicable laws and administrative procedures.
