Overview

Statutory Rules 1976 No. 182, made under the Public Service Act 1922, was enacted to address a specific gap in the allowances provided to members of the Public Service Board. The Public Service Board, exercising its authority granted by the Public Service Act, introduced this regulation to amend the Public Service Regulations, specifically by inserting a new Division VII concerning allowances for members of the Public Service Board. This legislative instrument aims to ensure that members of the Board receive allowances equivalent to those paid to officers of the First Division of the Australian Public Service. The regulation was approved by the Governor-General, acting on the advice of the Federal Executive Council, and subsequently notified in the Australian Government Gazette on 25 August 1976. The policy objective behind this amendment is to provide a clear and equitable framework for the remuneration of Public Service Board members, thereby ensuring consistency and fairness within the public service structure.

Scope and Application

The Statutory Rules 1976 No. 182, made under the Public Service Act 1922, concern amendments to the Public Service Regulations and apply to the members of the Public Service Board. These regulations specify the allowances payable to members of the Board, aligning them with the allowances that would be given to an officer of the First Division of the Australian Public Service. The regulation, approved by the Governor-General and dated 19 August 1976, extends its applicability across the Commonwealth of Australia. The specific insertion of Division VII into the existing regulations aims to ensure that members of the Board receive consistent and equitable compensation. The regulation does not explicitly state any exclusions or exemptions but rather focuses on the financial allowances for a particular group within the public service framework. Furthermore, this regulation can be extended or restricted through subordinate instruments, which may provide additional details or modifications to the allowances specified within the main act.

Key Provisions

The main operative sections of this legislative instrument pertain to the allowances for members of the Public Service Board under subsection 13(2) of the Public Service Act 1922 (sections referenced in parentheses). Specifically, section 103c states that the allowances a member of the Board shall be paid are those that would be payable to them if they were an officer of the First Division of the Australian Public Service. This means that the allowances for Public Service Board members are aligned with those of the highest-ranking officers within the public service structure. The regulation effectively ensures that members of the Board receive a level of remuneration commensurate with their significant roles and responsibilities. The obligations and requirements imposed by this Act on the parties or entities it governs primarily involve ensuring that members of the Public Service Board are paid allowances equivalent to those of First Division officers. This stipulation is crucial for maintaining the integrity and efficacy of the Board, ensuring that members are adequately compensated for their duties. The regulation seeks to uphold the standards of remuneration within the public service hierarchy, thereby maintaining fairness and consistency in the compensation structure across various levels of public service roles. Any breaches of the provisions set out in this legislative instrument could lead to significant consequences. While the specific offences, penalties, or civil/criminal consequences are not detailed in the text, it is reasonable to infer that failure to comply with the stipulated allowances for members of the Board could be considered a violation of the Public Service Act 1922. Such breaches could potentially result in legal action being taken against the non-compliant parties, with penalties that might include financial penalties or other administrative sanctions. Given the serious nature of the roles within the Public Service Board, the consequences for non-compliance are likely to be severe, ensuring adherence to the prescribed allowances.
