Overview

The Public Service Board, under the authority of the Public Service Act 1922-1975, enacted Statutory Rules 1976 No. 17 to amend the Public Service Regulations. This legislative instrument, which became effective on 19 January 1976, was approved by the Administrator of the Government of Australia following advice from the Executive Council on 20 January 1976. The primary purpose of these regulations was to repeal certain provisions (Regulations 97aa and 98ad) within the existing Public Service Regulations, thereby addressing any outdated or obsolete aspects of the public service administrative framework. The enacting body, the Public Service Board, ensured these amendments were aligned with contemporary governance needs and practices.

Scope and Application

The Statutory Rules 1976 No. 17, made under the Public Service Act 1922-1975, apply to the public service of the Commonwealth of Australia, encompassing all public servants employed by the Australian Government. This regulation impacts the conduct and operational practices within the public service, aiming to streamline and update the regulatory framework governing these employees. The geographical scope of this legislation is confined to the Commonwealth jurisdiction, thereby affecting all federal public service entities. The regulation involves the repeal of specific provisions, namely Regulations 97aa and 98ad of the Public Service Regulations, which were previously established to govern certain aspects of the public service. This repeal signifies an amendment to existing regulations to potentially refine or eliminate outdated or redundant provisions, ensuring the regulatory framework remains efficient and relevant. The regulation does not explicitly state any exclusions or exemptions but operates within the bounds set by the overarching Public Service Act 1922-1975.

Key Provisions

The key provisions of this legislative instrument concern the repeal of certain regulations under the Public Service Regulations (section 1). Specifically, Regulations 97aa and 98ad are repealed. These regulations likely pertained to specific administrative or procedural matters within the public service, and their repeal suggests a revision or streamlining of the regulatory framework governing public service operations. This change aims to update or simplify the regulations to better align with contemporary administrative practices or to address issues identified in the existing regulatory framework. The obligations and requirements imposed by this legislation are primarily focused on the administrative process. The Public Service Board, acting under the authority conferred by the Public Service Act 1922-1975, makes these regulations subject to the approval of the Administrator. The Administrator, acting with the advice of the Executive Council, subsequently approves the regulation. This dual layer of approval ensures that the changes are both authorised by the appropriate legislative body and reviewed by executive leadership, providing a safeguard against arbitrary or unauthorised regulatory changes. The involvement of the Administrator and the Executive Council highlights the importance and gravity of regulatory amendments within the public service. The legislative instrument does not explicitly detail offences, penalties, or civil/criminal consequences for breaches of the repealed regulations. However, given the nature of public service regulations, non-compliance with these or any other regulations could potentially lead to disciplinary actions against public servants, administrative penalties, or other consequences as stipulated in the overarching Public Service Act 1922-1975. The specific consequences would depend on the nature and severity of the breach, as well as any relevant policies or guidelines established under the act. The repealed regulations likely carried their own enforcement mechanisms, and their removal might necessitate adjustments in how compliance is monitored and enforced within the public service framework.
