Overview
Statutory Rules 1980 No. 227, titled "Regulation under the Public Service Act 1922," was enacted to amend the Public Service Regulations, specifically addressing the rates and conditions of district allowance for public service officers. This legislative instrument was introduced by the Public Service Board, exercising its authority under the Public Service Act 1922, and subsequently approved by the Governor-General. The regulation was enacted to adjust the allowances provided to public service officers based on their location and family status, ensuring that officers are compensated appropriately according to their living conditions. The intent behind these amendments is to maintain fair and consistent remuneration practices within the public service, reflecting the cost of living in different localities and the financial responsibilities of officers with dependants.
Scope and Application
The Regulation under the Public Service Act 1922 pertains to the amendment of the Public Service Regulations, specifically focusing on the rates and conditions of district allowances for public service officers. It applies to public service officers within the Commonwealth who are classified under various grades based on their locality and whether they have dependants. The regulation establishes different allowance rates for officers with and without dependants across six locality grades, ranging from the lowest grade one to the highest grade six. Geographically, the regulation is applicable across the Commonwealth, ensuring consistency in allowances for public service officers regardless of where they are stationed. There are no stated exclusions or exemptions within the regulation itself, but its application may be further defined or restricted by subordinate instruments. The regulation is effective from the date of its approval by the Governor-General and aims to standardise district allowances within the public service framework.
Key Provisions
The main operative sections of this legislation pertain to the amendment of the Public Service Regulations, specifically addressing rates and conditions of district allowance for public service officers. Under the amended Regulation 101, the table listing the rates of district allowance is revised to reflect new rates based on the grade of locality and whether the officer has dependants (Regulation 101(1)). This regulation now specifies higher allowances for officers with dependants compared to those without, with allowances ranging from $430 to $2,740 for officers with dependants, and $220 to $1,690 for those without, depending on the locality grade.
The obligations imposed by this Act primarily concern the Public Service Board, which is tasked with administering and enforcing the Public Service Regulations. The Board must ensure that public service officers are appropriately compensated in accordance with the amended rates set out in Regulation 101. This includes verifying the eligibility of officers for the district allowance based on their grade of locality and family status, and ensuring that these allowances are correctly calculated and disbursed.
Regarding breaches of the regulations, there are no specific offences, penalties, or civil/criminal consequences mentioned in the text provided. However, it is implicit that failure to comply with the amended regulations could lead to administrative actions or disputes over compensation, potentially resulting in legal challenges or appeals. The severity of such consequences would depend on the specific circumstances and the outcomes of any related legal proceedings. The regulation itself does not specify maximum penalties, which may be found in other sections of the Public Service Act or related legislation.
